OPEN MEETING, INVOCATION AND PLEDGE OF ALLEGIANCE TO THE FLAG

 Chairman Windham called the meeting to order and Councilman Addison gave the invocation and led the Pledge of Allegiance to the flag. Chairman Windham noted that 17 years ago, the Twin Towers were hit and said that we should all remember those who lost loved ones at that time.

REQUEST FOR MOTION ON ADOPTION OF RECOMMENDED AGENDA

 Mr. Watkins said that there was an addition to the agenda of 5B, which was the approval for the County to self-administer C Funds.

Councilman Beasley made the motion to approve the agenda with the revision. Councilman Addison seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON ADOPTION OF MINUTES FROM REGULAR MEETING OF AUGUST 14, 2018

 Councilman Fountain made the motion to approve the minutes from regular meeting of August 14, 2018. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON ADOPTION OF FIRST READING APPROVAL OF ORDINANCE

  1. AN ORDINANCE DEVELOPING A MULTI-COUNTY PARK WITH DARLINGTON COUNTY; AUTHORIZING THE EXECUTION AND DELIVERY OF AN AGREEMENT GOVERNING THE MULTI-COUNTY PARK; AUTHORIZING THE INCLUSION OF CERTAIN PROPERTY LOCATED IN DARLINGTON COUNTY IN THE MULTI-COUNTY PARK; AND OTHER MATTERS RELATED THERETO

Mr. Watkins said that this is an expansion of an existing agreement in which Darlington County is enlarging the area. He said that Lee County would collect 1% from this agreement.

Councilperson Caughman made the motion to approve for first reading approval of ordinance. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPROVAL TO ENTER INTO AGREEMENT WITH REVIZE GOVERNMENTAL WEBSITES

Mr. Watkins said that he met with the Planning, Taxes & Personnel Committee to discuss this matter. He said that the county currently has a website but it is not user friendly and does not have the capability for access for information.

He said this agreement would be four years for a total of $23,000, which could be divided into payments of $6600, with the last payment being $3300. He said this company would help us build our website and update our current information.  Mr. Watkins said that he had a meeting with department heads and elected officials and gave them a list of websites this particular company handles and asked them for their input on any information they would like to see placed on the website for their department.

Councilperson Josey made the motion to approve to enter into agreement with Revize Governmental Websites. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPROVAL FOR THE COUNTY TO SELF-ADMINISTER C FUNDS

Mr. Watkins said that he met with the Local Transportation Committee, which consists of Al Holland, Tom Drayton, Andrew Moses and Will Wheeler attended. He said that the County has worked on projects with SCDOT and they have reimbursed the county for road projects.  He said that Herb Cooper has retired and is helping counties set up their C Funds.  He said that the state has historically kept 3% for administering the C Funds projects.  Mr. Cooper said that he would help the County establish the process for doing this and the County would keep the 3%.  Mr. Watkins said that the County will do all the leg work and now we will write the checks instead of SCDOT.

Mr. Watkins said that once a year, the county would be audited, and Mr. Cooper would help with that, if needed. He said that the money will come directly from DOR to the County and the money will be placed in restricted account.

Mr. Watkins said under the state law a minimum of 25% has to spent on state roads and the balance basically can be spent on what the committee deems appropriate on either county or state roads. Mr. Watkins said the majority of county roads are state roads.

Councilman Beasley made the motion to approve the County to self-administer C Funds. Councilman Addison seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPROVAL TO ENTER INTO AGREEMENT WITH SANTEE LYNCHES REGIONAL COUNCIL OF GOVERNMENTS ON THE 5 YEAR COMPREHENSIVE PLAN UPDATE AND TECHNICAL SERVICES

Mr. Watkins said the County updates this plan every five years. He said that this helps the county plan for land development and is a tool for economic development.  He said that Santee Lynches will assist us with any updates.  He said that the cost to update the comprehensive plan is $10,000, and the county has already paid $5314, so an the balance of $4686 would be needed to do this and could be done in four installments.

Councilman Beasley made the motion to enter into agreement with Santee Lynches Regional Council of Government on the 5 Year Comprehensive Plan Update and Technical Services. Councilman Fountain seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

COMMITTEE REPORTS

  1. HEALTH, EDUCATION AND WELFARE

Councilperson Josey said that it was time for everyone to get their flu shot. She said that everyone needed to lookout for each other with the upcoming storm.

  1. PLANNING, TAXES & PERSONNEL

Councilman Beasley said that his committee did meet once regarding the website, in which the committee was able to view some other websites that REVIZE maintains.

  1. BUILDINGS, LAND & PROPERTY

Mr. Watkins said that additional work is being done on the floor joists on Ashwood Gym and is currently closed.

Mr. Watkins talked to Jay Schwedler about the site pads and has he secured funding of $1.1 million, via Black River, SCDOC, SC Power Team, and local funding of $50,000 from sale of spec building.

Chairman Windham said that progress is being made on the reopening of the post office. He said that roof has been replaced and the projected open date is October 1.

Chairman Windham also said that progress is being made on Lake Ashwood. He said that it is owned by the school, and leased to SCDNR.  He said that concrete has been poured and the pond still needs to be cleared of the trees.

Councilman Addison asked about the back area at Bishopville High School. Mr. Watkins said the back area is used as storage by the school.

  1. PUBLIC SAFETY

Councilperson Caughman said that her committee had no meetings. She commented how important public safety is to our county.

Mr. Watkins did say that EMS took possession of two ambulances and the Sheriff’s office took possession of two new vehicles.

  1. RECREATION AND PUBLIC RELATIONS

Mr. Farver was not present. Mr. Watkins said that everything in the department is going well and football registration is complete.  He said that Mr. Farver had hired one staff member, Shannon Reddick, which gives him 2 full time, and one part time, plus 4 additional part time staff members to help with program.  He said they were looking at adding another staff member.

Councilman Beasley said that pull up bars had been added to Woodrow Park.

Mr. Watkins said that he and Michael Farver are going to meet with Councilperson Caughman on September 29 about Fall Festival. He said that public works had already started clean up.

  1. WAYS AND MEANS

Mr. Fountain said that his committee had no meetings.

Mr. Watkins said that the County took possession of bond proceeds and the audit procedure has begun for the last fiscal year.

  1. ADMINISTRATOR’S REPORT

Mr. Watkins said that everyone especially needed to remember the public safety personnel and their families who were involved in 9/11. He said that he had been involved in EOC meetings regarding the storm.  He wanted to recognize Mike Bedenbaugh, Danny Simon, Calvin Collins, Suzette Robinson, Freddie DuBose, Andre Laws and EMS.  Mr. Watkins said the storm has moved a little further north but the impacts could go out a ways, depending where it makes landfall.  He said the County could have sustained winds of 30-40 mph and high intensity winds with 4-5 inches of rain.  He said there is a good chance the county could have trees down and power outages.

Councilman Addison asked if he got phone calls with questions, who did he need to call. Mr. Watkins said that he could call him or 911. Chairman Windham asked about the hours of operations for the courthouse.  Mr. Watkins said that all state offices and public schools were closed.  He said the counties were given the option of deciding whether to close.  Mr. Watkins said they were going to meet today at 2:00 to see about advisories.  He said that he anticipates for the County to be open tomorrow all day and will make determination about Thursday based on weather reports.

Councilman Addison asked about the transportation busses. Mr. Watkins said the busses could be utilized if needed.

Mr. Watkins also said that Santee Lynches is having a public hearing tonight at 6 p.m. at Cousar Memorial Church regarding dilapidated housing. He said that September 17 is the deadline.  He said that two steps have to take place:  (1) have to have a majority to sign release (2)  LMI study has to be done in the Blue Pond/Harlem area

Councilman Addison said that even though the Harlem Blue Pond area was chosen, hopefully more areas can be chosen to clean up on the next round of funding.

PUBLIC COMMENT

Douglas Mixon – said that he was appointed a year ago to the Mental Health Board. He said that was interested in seeing some refurbishments to the Mental Health Center.  He said that wanted to extend appreciation to Lee County for providing a place for Mental Health.

REQUEST FOR MOTION ON ADOPTION OF MINUTES FROM REGULAR MEETING OF JULY 10, 2018 AND CALLED MEETING MINUTES OF JULY 31, 2018

 Councilperson Josey made the motion to approve the minutes from regular meeting of July 10, 2018 and called meeting of July 31, 2018. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPROVAL TO PURCHASE AMBULANCES FOR EMS

 Mr. Watkins said that this is a part of the bond issuance in which the county is issuing a bond for approximately $900,000. He said this has gone out for bid and September 6 is the closing date.

Tim DuBose that EMS currently has eight ambulances. He said that two of them will be coming off and replaced with new ones, with one being a 2004 model and the other being 2008. He said that DHEC is requiring EMS to have a special design track to secure the stretchers.  Mr. DuBose said the cost for the trackers is $13,000, and he said this a DHEC mandate.

Mr. DuBose said the low bid was from First Class Emergency Vehicles. He said this was for two Ford #450V Gas Ambulances at $129,989.00 each.

Councilperson Caughman made the motion to accept the low bid of $259,978, or $129,989 each. Councilman Fountain seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPROVAL TO PURCHASE SHERIFF’S VEHICLES

 Sheriff Danny Simon was present to give information on the proposal for the vehicles. He said that as of 2022, he will be ordering SUVs or trucks, rather than cars, because it will be more cost effective mainly for safety features.

He said he currently has 15 deputies with 16 slots and he does not have enough cars for the deputies that he has. He said that a sedan cost from $28,000-$33,000 and has to be equipped with different things. He also said that in 2-3 years, every vehicle will have computers to do E-tickets instead of written tickets.

The proposal was for 2 SUVs valued at $35,399.90 each; 2 Pick up trucks valued at $36,026.98 each; 4 cars valued at $33,291.06 for a grand total of $276,018. He did comment that these vehicles would replace the ones that were purchased in 2012.

Councilman Fountain made the motion to accept the low bid of $276,018 to purchase vehicles for the Sheriff’s Office. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REVIEW OF CDBG GRANT APPLICATION TO ADDRESS DELAPIDATED HOMES IN UNICORPORATED AREAS

 Mr. Watkins said that he, along with Kyle Kelly, Chris McKinney, Councilman Addison and Councilman Beasley met to discuss this matter.

He said this a problem in the county in which these houses are not livable and are falling down. He said these property owners do not want to invest in these homes.

Mr. Watkins said that funding would be coming up this fall and we would be concentrating on blocks of areas and would be working with City of Bishopville and would probably start between the interstate and City of Bishopville. He said that hopefully more homes would be done in the future.

He said that the grant application is for $276,000 for the Harlem Blue Pond areas, with 27 homes or structures to consider. He said that approximately $10,000 would be allocated for each property to remove structure.  He said the property owner has to sign off.  Mr. Watkins said the initial application is due Friday, which allows the County to be an applicant.  He said the time limit is 3 years. He also said if they sell the property within 3 years, they will have to reimburse the County for the money that was spent.

Mr. Watkins said the formal application will require further action by the Council. He said that 5% can be in-kind services.  He said that Councilman Addison and people in the community provided a list of homes to be considered.  He said that the City had already compiled a list.

Vice-Chairman Eckley said that if some of the structures are located in the City, then they should share in the cost.

Councilman Addison asked about the overgrown vegetation in the yard, and Mr. Watkins said that he was not sure how far they would be able to go in the yard to clean. Councilman Addison also asked about if old cars could be removed from the yard, and Mr. Watkins said that he would have to check with Santee Lynches.

Chairman Windham said that it is a selling point in which after three years, the person can sell the property and the value of the property will have increased. He said there would be no cost to the property owner.

COMMITTEE REPORTS

Councilperson Josey thanked Andre Laws and his Council for getting a Dollar General in Lynchburg. She said that it has brought in traffic and was a good thing for their town.

She said she attended Association of Counties in Hilton Head and said it was very educational.

Vice-Chairman Eckley said that work on the damaged maintenance building at old Bishopville High School was near completion. He said this was being paid for by the insurance company because of the claim filed.

  1. PUBLIC SAFETY

Councilperson Caughman said her committee had no meetings.

Tim DuBose thanked the County Council for the cost of living raise for his employees and the approval to purchase new ambulances.

He said EMS continued to train every month and was doing dispatch training.

He said that his E911 employees were doing emergency medical dispatch training in which they would ask more questions to gather information from the caller and give instructions until EMS gets there.

Sheriff Danny Simon also thanked the Council for the cost of living raise for his employees. He said that he and his department participated in an active shooter training which was conducted by the Chester Sheriff’s Department.  He said that it will be now be required to do two active shooter training every year at every school.

He said that a task force of Chester, Fairfield, Laurens and Union counties have joined together to try to eliminate some of the theft issues taking place since May 1. He said there have been utility trailers and lawn mowers stolen and several church break-ins.

He also reported that it is getting hard to find qualified officers to work now.

  1. RECREATION AND PUBLIC RELATIONS

Michael Farver said they were in the middle of the interview process and will hopefully interview two more.

He said that football registration is going on now and they were in the process of working to certify existing football helmets and getting rid of those that were not in compliance.

He also reported that his department was working on securing Green Acres park to protect children.

He said the recent job fair was successful. He also said that the Care South back to school giveaway was successful and said that 1500 people came through and they gave away 1000 book bags and also fed the children.

Councilman Addison said that Farver was still a new recruit. He asked Farver how many people currently work for Parks and Recreation and Farver answered that he had 1 full time and 4 part time.  Councilman Addison told Farver that if he needed help, then he should ask for it.  He also told him he was doing a good job.

Bettye Scott said that transportation was doing well. She said that ridership is increasing and they have plans for expansion of routes and they have short term plans and long term plans.

Sandy Jenkins said that Bettye Scott will be attending a conference in which she will be recognized nationally in the area of county transportation. He said the state of Virginia is to consult with Lee County Transit to determine how they started their program.

Councilman Addison said the Transportation Committee needs to give Council a report of the ridership, trips, etc.

Chairman Windham said that it may be beneficial to have the routes posted at each drop off spot and that may increase ridership.

Ms. Scott thanked Council for the present and future support.

  1. ADMINISTRATOR’S REPORT

Mr. Watkins said that a job fair was held on August 8 and was very successful and was a joint effort between SC Works and the COG. He thanked the Recreation Offices for their assistance. He also thanked the Sherriff’s Office for providing security.  He said approximately 40 businesses participated.

He also said the general obligation bond is out for bid and would close on September 6 or September 7.

Mr. Watkins said he attended a local transportation committee meeting that was very informative. He said that Herb Cooper, the previous C Fund Director with SCDOT, was present and was now a consultant for DOT.  He said that he would help the county transition the C Funds Program to a county level.  He said the state has been keeping 3% as administrative fee, which amounts to approximately $30,000 a year.  Mr. Cooper said that if the county handles the C Funds on a local level, they would be able to keep that money.  He said the county would be audited once a year.

Mr. Watkins also commented that the ESteam Outdoor Festival would be on October 6 and would have interactive displays for science and math. He said that students would be encouraged to attend, especially those interested in pursuing careers in engineering, etc.

He said that all of the schools in Lee County have been invited.

Mr. Watkins also said that Dr. Pate has been welcomed back to Bishopville. He said that his practice with McLeod Health had been closed and moved to Florence.  He said that Representative Wheeler took the initiative and pursued a program for residents through Palmetto Health and MUSC and helped Dr. Pate reopen his practice.  He said that offices have reopened and his equipment has been updated.  He said that rural residents will be working out of this office with Dr. Pate.

Mr. Watkins also commented that CareSouth would be opening a dentist office soon.

PUBLIC HEARING

 TO LEVY AND IMPOSE A ONE PERCENT SALES AND USE TAX, SUBJECT TO A REFERENDUM IN LEE COUNTY, PURSUANT TO THE CAPITAL PROJECT SALES TAX ACT

The public hearing was opened at 9:30 a.m. on a motion made by Vice-Chairman Eckley, seconded by Councilperson Josey.

Mr. Watkins said that the renewal process began several months back with the appointment of penny tax commission, which consists of Ronnie Williams, Derrick Brown, Deborah Wilson, Ken Currie, and James Brailsford. They had a series of meetings and met with persons requesting funds for various projects.

The list has been finalized by the commission and being presented today.

Mr. Watkins said that Michael Kozlarek has handled and coordinated all meetings with the commission.

Mr. Kozlarek said the commission had a series of meetings and met with various agencies and was presenting the final list of projects today. He said that the Resolution was part of the Ordinance that was being approved today.  He said that using the 2017 population estimate, the County would receive 79.9%, the City of Bishopville would receive 18.1% and Lynchburg would receive 2% of proceeds of the penny sales tax.

Mr. Watkins said that if the Ordinance is approved for third reading, this item will be on the ballot in the November election.

Mr. Kozlarek said that Council cannot amend the list of projects because the commission approved them.

Chairman Windham said that if the Council doesn’t do this and this doesn’t pass, the County will probably have to impose a tax increase.

Michael Kozlarek said that the estimated amount of money the commission came up with is just an estimate based on current collection of existing capital penny. He said the projects will be funded in the order as the money comes in.

He said the County could borrow up to $5 million in advance to start projects before money comes in. He said that for county to generate that amount of revenue, the county would have to generate 100 mills of tax. He said that 70% of the revenue will come from the interstate.

Mr. Kozlarek said that statutorily, which is eight years, the renewal can be 7 years. The County will lose $900-950,000 because we will be losing a year’s worth of revenue.  He said that this will take effect on May 1, 2021, which will be a continuation of the penny already in place.

Councilman Addison asked if the money could only be spent for those items. He also asked about the wording of related costs on the ballot information.

Mr. Kozlarek said that this gives citizens an ideas of what they’re voting for.

Chairman Windham said that since this will not be effective until May, 2021, it is hard to be specific as to what will be needed at this time.

Councilman Addison said that the wording could be simplified. Mr. Kozlarek said that he considers the length of the wording on the ballot and said that citizens do not want too much information to read through.

Councilman Addison said that transportation was cut to the point that it will be probably be out of funding.

Mr. Watkins said that there were two line items for transportation: 140,000 and 60,000 which equals to $200,000, which was designated over the first eight years on the penny sales tax.  He said to date, $83,000 of the $200,000 has been spent and they have done everything they could have requested up to this point.  He said that $110,000 was left in the first penny that can be used to acquire federal funding.  With this said, Lee County Transportation would have over $800,000 to spend to operate.  He said they requested funding of $800,000 to provide for future and existing needs.  Mr. Watkins said the County already commits $40,000 in operations and has done since the inception of transportation program. Mr. Watkins said that this penny sales tax money cannot be used for operations.  He said that $110,000 is already in place to match with federal dollars to draw down $500,000.  Mr. Watkins said there is plenty of money for transportation to accomplish the transportation goals.

Chairman Windham said that a log of the number of riders would be helpful to council to see how much the transportation system is used in the county.

PUBLIC COMMENT

Betty Toney – She wanted to confirm that the new penny will end in 2028. Mr. Watkins said that the County could only put on the ballot in general election years.  Mr. Watkins said that there are many grant opportunities for public safety to seek dollars, which is a big reason that public safety is on the list.  He said that 15 out of 16 projects have been completed with the current penny.  He said this frees up bond money, which is another reason to do it earlybfor budgetary purposes.

She said that with the projects not being funded this time, these projects would have to wait until 2028. She said the County may possibly have a new a list of projects for 2026.

Mr. Watkins said that most of this is dedicated to public safety because this is the only source of money that we have to do it with.

Chairman Windham said the county allocated for the fire station in Lucknow, but we are not doing anything now because we don’t have the money for a fire truck.

Mr. Watkins said the County will likely complete all of these projects.

Chairman Windham reiterated again that this was a recommendation by this capital penny sales tax commission to council.

Betty Toney commented so there’s no need for any group to ask for funding because this penny sales tax is tied up with emergency vehicles and public safety stuff.

Mr. Watkins responded that the County has built fire stations to help with people’s home insurance because fire stations were five miles or less located from their home.

Ruby Gibbes – she said that three outside agencies presented information to the committee. She asked if the committee consider the agencies could get funding or is feasible for these agencies to plan for future purchases.  She asked if the commission considered any overage to do any of the projects that will not be funded.

Chairman Windham said the current penny project did not complete every project listed.

Councilman Beasley said that if any money comes in extra or there is extra money available after all projects are done, then the council could vote to appropriate the money, as long as it’s not operations.

Ruby Gibbs said that it is unfair because these agencies took the time to plan, and there’s going to be leftover money.

Mr. Watkins said that it has to be a defined project because the voters have to know exactly what they are voting for.

Councilman Addison asked if there was a possibility that money will be left over and will the leftover money roll over into the next project.

Carrie Gass – she said that once the tax is levied, it’s hard to take it off.

She asked how the County is using the present penny sales tax. She asked when the gym is going to be remodeled.  She asked how the money is being spent.

She mentioned the “outhouses” at Garrett Field. She mentioned there have been complaints about the splash pads with no water pressure.  She asked if there were grants to do these things.

Mr. Watkins said that remodeling of the old Bishopville High School will not take place under the current penny, but is listed as Number 7 on the new penny sales tax project.

Mr. Watkins said that both Dennis and Grammar School Parks have portapotties and that we should hold everyone to the same standard.

 JAY SCHWEDLER WILL GIVE AN UPDATE ON PLANS FOR INFRASTRUCTURE IMPROVEMENTS OF I-20 PARK

 Mr. Schwedler was present and said that county was considering construction of multiple pad ready sites, one being 50,000-75,000 square feet and one being 100,000-150,000 square feet.

He also said that he was meeting with a prospect for a second site visit that was looking at Lee County that was a $7 million investment with 40 new jobs, with the pay of $14-17 an hour.

He said that a STEAM festival would be held in Sumter in October. He said that it would consists of vendors, exhibitors and interactive displays.  He said that it will be free .

Mr. Schwedler said that Martech is doing an expansion and South Atlantic Canners have added another line. He said that Crowne is up to 154 employees and the unemployment rate is down for Lee County.

Vice-Chairman Eckley encouraged the School Board and the Superintendent to support STEAM festival.

RESOLUTION TO AUTHORIZE ENGAGING AUDITORS FOR ANOTHER THREE YEAR TERM

Mr. Watkins said the County has used Sheheen, Hancock and Godwin for several years and they do an excellent job. This resolution would approve another three year term for their service.

Councilman Fountain made the motion to approve this resolution to authorize engaging auditors for another three term. Councilperson Josey seconded the motion.  Vice-Chairman Eckley called for the vote, and motion carried.  All voted in favor.

ACCEPTANCE OF CDBG GRANT FOR THE ELLIOTT/ENGLISH CROSSROADS WATER EXTENSION

 Mr. Watkins said that Lee County is accepting a grant for the Elliott/St. Charles area to allow Cassatt Water to run infrastructure for water.

councilperson Josey said that the citizens do need this because of the water quality. Councilman Beasley said that he was thankful to Councilperson Josey for going through with this process.

Councilperson Josey made the motion to approve the acceptance of CDBG Grant for the Elliott/English Crossroads water extension. Councilman Fountain seconded the motion.  Vice-Chairman Eckley called for the vote, and motion carried.  All voted in favor.

RESOLUTION AUTHORIZING 2018 GENERAL OBLIGATION BOND

 Mr. Watkins said this resolution identified the capital projects as a part of the General Obligation process. (The list of projects is attached).  Mr. Watkins said the County would issue $900,000 to $1 million every two years.

Councilman Beasley made the motion to approve the Resolution authorizing 2018 General Obligation Bond. Councilman Addison seconded the motion.  Vice-Chairman Eckley called for the vote, and motion carried.  All voted in favor.

Michael Farver was present and thanked the Council and Alan for having the confidence in him to do this job. He said they had a great baseball season and said they were not having any softball this year.  He said he was trying to get feedback from the public on new programs and one new program was adult softball.

He said that the position for the assistant to the Director had been advertised and the deadline is July 19.

Councilman Addison said that he supported Mr. Farver.

Councilman Fountain said that the budget was balanced without a tax increase and the County was able to give employees a 1% cost of living raise.

  1. ADMINISTRATOR’S REPORT

Mr. Watkins said the list for roads that needed to be rocked should be completed this week. He said the County has $50,000 to spend.

Mr. Watkins said the capital penny sales tax process is underway with meetings on July 16 and July 26. He said the public hearing and the third reading would be July 31, 2018.

He said the county will have a 7 year renewal but will lose one year of revenue of 900,000 because of statute of limitations.

PUBLIC COMMENTS

Carrie Gass – She said that Salkahatchie was in Bishopville last week and repaired 7 homes. She said that the churches fed them every day.

She also said that the parking lot at the old Bishopville High School was beautiful but wanted to know how to get on the ballfield in a wheelchair. Mr. Watkins said that handicapped persons are allowed on the field level.

Ms. Gass said substandard housing in Lee County is a problem. She said that people are need in of repairs to their homes but cannot afford it.  She asked what people are supposed to do.  She asked if there were any grants available to do this.

LEE COUNTY BUDGET FY19

The public hearing was opened at 5:30 p.m. on a motion made by Councilperson Josey, seconded by Councilperson Caughman. Chairman Windham called for the vote, and motion carried. All voted in favor.

He said the Ways and Means would have at least more meeting to finalize and balance the budget. Public Comment:There were no public comments from the audience. The public hearing was closed at 5:45 on a motion made by Councilman Fountain, seconded by Vice-Chairman Eckley. Chairman Windham called for the vote, and motion carried. All voted in favor.Mr. Watkins said that the County would also be doing a General Obligation Bond again this year. He said the goal is to sustain the level of millage of 18 mills and pay off existing debt. He said the bond would be for $900,000 and would pay off the 2016 Bond.Mr. Watkins said that the mandated retirement costs had increased $60,000.  He said that health insurance costs had also increased $60,000, which would be effective January 1, 2019. However, the workers comp insurance had decreased in premium from last year. He also said there would a freeze on full time positions, however, the departments would be allowed to replace someone if they leave. He said there would also be a freeze on outside agencies at the current level.

Mr. Watkins said that one of the major components of the budget was that two full time positions was moved from E-911 and EMS to Administration. He also said that the county would begin charging a convenience fee 1.55% for the use of debit and credit card usage. He said that the county currently receives over $1 million each year of debit and credit card usage.He said that the current deficit was $15,602.20, with a projected revenue of $12,650,776, and projected expenses to be $12,666,378. Mr. Watkins said that the Ways and Means had met several times to work on first reading, in which all budget requests were included, which resulted in a deficit of $407,437

.LEE COUNTY SCHOOL BUDGET FY 19 

The public hearing opened at 5:46 p.m. on a motion made by Councilperson Josey, seconded by Vice-Chairman Eckley. Mr. Watkins recognized Dr. Wanda Andrews and she introduced her staff.

Ms. Sharika Anderson, Finance Director, said that the budget was balanced, with the revenue and expenses at $15,469,234, respectively. She said it was a decrease of $194,918 from last year. Ms. Anderson said that the budget was funded at the current rate of $2625 per pupil.  She said that the school had a decrease of $300,000 of EIA funding, and a salary increase of 1%   Ms. Anderson said the final count for students was at 2,022.

Dr. Andrews said that 30 positions were going to be cut with next year’s budget. Mr. Watkins said that of the total budget, the county is responsible for local sources of revenue, which includes local tax millage and various local fees.  The total amount of mills from last year was 139.83, and the requested amount of mills for next year’s budget was 2.13, making it a total of 141.9 millage rate.  He said the property taxes and vehicle taxes goes directly to the school.

Frank Millican asked Ms. Anderson if they were cutting 30 positions next year. She answered yes.  He asked what areas the jobs would be cut in.  Dr. Andrews said they do not have that information right now, but probably some teaching, some food services, and some retirees.

  1. PROPOSED MAP AMENDMENT TO REZONE TAX MAP NUMBER -038-00-00-013 OWNED BY SOUTHERN GAINS LLC FROM A GENERAL COMMERCIAL (GC) TO RURAL DISTRICT (RU).

Mr. Watkins said that this is one of the six sites that was part of the FILO agreement. He said it is located off Mac Stuckey Road, and is currently zoned General Commercial, and will be changed to Rural District.

He said the public hearing is scheduled for June 21, 2018 and said this will be similar to the other sites.

Councilman Beasley made the motion to approve for first reading. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and Councilman Addison did not vote in favor.  The vote was 6 in favor and 1 not in favor.

Councilman Addison said his concern was that this was prime property that could be used for industry since it was located adjacent to James Industrial Park and I-20 Park.

Mr. Watkins said the County had experienced substantial increases in the past several years regarding jail costs. He said the cost is divided between Sumter and Lee Counties, based on inmate days.

He said that the cost will be figured on a five year average with fifth year coming off. He said the percentage of use would not go up or come down by more than 1%.  He said the operation of the jail falls under the Sumter County Sheriff’s office.  He said that the county will be responsible for 10% of any capital needs, and they can be financed over a five year period.

Mr. Watkins said Lee County’s portion to the jail would be $689,000 for this year.

Councilperson Caughman made the motion to approve for second reading. Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

Councilperson Josey recognized Dr. Andrews to give an update. Dr. Andrews said they had 139 graduates this year and 98 are enrolled in colleges.  She said that they received $5.9 million in scholarship funds and 16 students were joining the military.

She said the schools were doing summer camps again this year. Dr. Andrews said that August 15 would be the opening day of the new school year.

 Mrs. Frances Drayton was present and gave information on the possibility of a homeless shelter. She said they had partnered with the churches here and possibly had acquired a site.

Mr. Watkins said the projected revenue is $12,465,047.56 and the projected expenses are $12,872,484, which leaves a deficit of $407,437.56. He said that retirement increased as well as health insurance on the employer side, but the workers comp insurance decreased.

Mr. Watkins said that you could only increase the millage by 2.13, which would be a little over three mills, and the maximum this could generate would be approximately $100,000. He said the County is planning to do a General Obligation Bond for $940,000 and a copy of the Project Needs Capital List is attached.   (See attached).
Councilman Fountain made the motion to approve the Lee County Budget FY 19 for first reading. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

  1. LEE COUNTY SCHOOL BUDGET FY 19

The Lee County School is still working on their budget, but the figure that is being considered for first reading is 139.8 Mills, which is subject to change when the School District submits their formal request for funding at the second reading, which will be the public hearing for the county and school budgets.

Councilperson Josey made the motion to approve for first reading of the Lee County School Budget FY 19. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

  1. TO LEVY AND IMPOSE A ONE PERCENT SALES AND USE TAX, SUBJECT TO A REFERENDUM IN LEE COUNTY PURSUANT TO THE CAPITAL PROJECT SALES TAX ACT

Mr. Watkins said this was set to expire in April, 2021. He said that he met with the City about renewing the penny sales tax.  He said this tax would continue to be collected for 8 more years.  He said that the County and City would appoint a commission and would go through the same process.  He said the committee will meet and come up with projects deadline by August 15.

Mr. Watkins reviewed the list of completed projects, which is attached. (See attached)

Councilman Beasley made the motion to approve for first reading. Councilman Addison seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

  1. REVISION OF JAIL CONTRACT WITH SUMTER COUNTY FOR THE OPERATION OF THE SUMTER/LEE DETENTION CENTER

Mr. Watkins said that he met with Public Safety Committee and they moved to revise our current contract with Sumter. He said that the County would need to have the public hearing before finalized changes in jail on a yearly basis.

Councilman Beasley made the motion to approve for first reading. Councilman Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

INDUCEMENT RESOLUTION FOR PROJECT LYCHEE

Mr. Watkins said this is the solar project, and this was basically a summarization of our fee arrangements and Southern Current. He said that this project would generate $282,000 per year in revenue for 10 years.  He said that approximately $244,000 would be generated for the next 20 years.  He said there are six solar sites currently in Lee County.

Councilman Beasley made the motion to approve the Inducement Resolution for Project Lychee. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPROVAL OF LOW BID FOR ROOF REPAIR ON OLD RECREATION OFFICES AT BISHOPVILLE HIGH SCHOOL

Mr. Watkins said this was roof repair for the former Recreation offices, as a result from storm damage. He said that the net cost to the County was approximately $5,000 and the rest would come from FEMA and insurance proceeds for storm damage.  The low bid for roof repair was from Eagle Construction in the amount of $55,000.

Councilman Addison made the motion to approve the low bid for roof repair on old recreation offices from Eagle Construction. Councilman Fountain seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

Mr. Watkins read the resolution and gave an explanation to Council on the background of this resolution.

PROCLAMATION DESIGNATING MAY 12, 2018 AS BATTLE OF THE DRUMLINES DAY IN LEE COUNTY

Mr. Watkins said this was a request from Lee Central High School. He read the proclamation.

APPOINTMENT OF TIM DUBOSE TO THE PEE DEE REGIONAL EMS BOARD

Mr. Watkins said Mr. DuBose would do a great job in this capacity.

Councilperson Caughman said that her committee met on May 1 to discuss jail contract. She said she wanted to commend all EMS personnel who responded to the incident at the prison.

Councilman Addison asked Mr. Watkins to update Council on the department. He said that work was still being done on the old Bishopville High School building.  He said that Relay for Life was being held on the football field at old BHS.  He also said that Magnolia Festival was coming up. Mr. Watkins said that baseball programs were going on.

Mr. Watkins also said that Thaddeus Dickey had resigned to pursue other things and we wished him well.  Mr. Watkins said that the County was in the process of hiring another director.

Councilman Addison recognized Carrie Gass and she spoke of substandard housing in Lee County and said this is a real problem. She also said that Salkahatchie Week would be the last week of June.

He recognized Bettie Toney and she spoke of the post office and said she tried to get a petition going and said that people quit signing it because work had begun on the building.

Mr. Watkins said that both senators had been contacted and said that the post office should be operational October 1.

Mr. Watkins also said that the start date of the paving for Pee Dee Math and Science School would be June 11.

Councilman Fountain said that his committee is working on budget and the goal is to balance the budget without a tax increase.

PUBLIC COMMENT      

Frank Millican had some concerns about the timing of the capital penny sales tax project and asked why it was being done in such a hurry when it wouldn’t take effect until 2021.

Mr. Watkins said that the County has accomplished most of the projects on the list from the last capital penny project. He went on to say that if the County knows what we need, this will give us an opportunity to seek additional funds to match funds.

Mr. Millican also asked why the County would want to tie up the funds for eight years. He then said the schools needs to be involved.

Councilman Beasley said that any organization can come before the commission and make a presentation.

Frances Drayton said she hopes they will come before the commission regarding the homeless shelter.

Mr. Watkins said this is an agreement that counties put in place to help one another during a disaster. He said that counties put this in place ahead of time in the event of an emergency.

Tim DuBose said that the phone system upgrade for E-911 has been completed. He also said that EMD training will start the first of May for dispatchers.

He said that EMS has responded to 1226 calls to date, with 120 calls for April. He also reported that May 5 is Relay for Life which will be held at the old Bishopville High School ballfield.

Mr. Fountain was not present. Mr. Watkins said that he has received budget requests from Department Heads and Elected Officials and outside agencies. He said that he would be scheduling a Ways and Means Committee meeting in May.

He said the Employee Insurance was going up 7.4% and retirement was going up. He said that it would be another tough budget year.  He said the Local Government Fund would be funded the same as last year.

PUBLIC COMMENT

Andre Laws said the Magnolia Festival would be on May 5 and invited everyone to attend. He said that Will Wheeler would be the Grand Marshall.

Pat Carter invited everyone to the Junteenth Festival on June 16 at the Mary McLeod Bethune Park

Ruby Gibbs Williams invited everyone to the Dr. Mary McLeod Bethune Walk on May 19 at 8:00 a.m. She said it would be a five mile walk.

Carrie Gass invited everyone to Mechanicsville UMC for a Health and Safety Fair on April 14.

Mr. Watkins briefed the Councils on the role of the LINK in promoting Lee County and reviewed the investments in the industrial parks. He briefed the Councils on the infrastructure needs for future growth and also discussed the potential for constructing another spec building.

Mr. Watkins discussed the current projects underway: (1) Martech Expansion (2) South Atlantic Canners (3) Crowne Healthcare Laundry Services (4) Carolina Metal Finishing (5) Solar Investment.

Ennis Bryant suggested that the City and County take the bus to tour the Advanced Manufacturing Training Center in Sumter.

Mayor Alexander thanked Alan for briefing and updating everyone on economic development and the parks.

Mayor Alexander then said that the flooring/carpeting in the City/County Complex needed to be replaced.

Mr. Watkins said he was forwarded this agreement by the SCEMD, and this was in relation to responding to emergencies in other counties and providing assistance in large scale events. This agreement outlines each counties responsibilities and if there are items that need to be reimbursed.

REQUEST FOR THIRD READING APPROVAL OF ORDINANCE

  1. PROPOSED MAP AMENDMENT TO REZONE TMP 037-00-00-006 OWNED BY ROBERT B HILTON FROM A GENERAL COMMERCIAL (GC) TO RURAL DISTRICT (RU)

Mr. Watkins said the county had public hearing in regards to this solar project. He said there were six sites in Lee County and this was a permitted use in a rural district.

He said this particular piece of property was located along Highway 341 right beside Mac Stuckey Lane, between Mac Stuckey Lane and the prison.

Ms. Olyesia Pavlenko had Mr. Richard Kirkland to provide information which stated that property values on property with solar farms had either maintained or increased in values.

Vice-Chairman Eckley made the motion to approve for third and final reading. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and Councilman Addison opposed the vote, with the other six Councilmen in favor.

ORDINANCE AUTHORIZING PURSUANT TO TITLE 12, CHAPTER 44 OF THE CODE OF LAWS OF SOUTH CAROLINA 1976, AS AMENDED, THE EXECUTION AND DELIVERY OF FEE-IN-LIEU OF AD VALOREM TAXES AGREEMENTS BY AND BETWEEN LEE COUNTY, SOUTH CAROLINA AND CERTAIN COMPANIES AS SPONSOR AND SPONSOR AFFILIATE, RESPECTIVELY, IDENTIFIED COLLECTIVELY FOR THE TIME BEING AS PROJECT LYCHEE, TO PROVIDE FOR FEE-IN-LIEU OF AD VALOREM TAXES INCENTIVES AND CERTAIN SPECIAL SOURCE REVENUE CREDITS; AND TO MODIFY A JOINT INDUSTRIAL AND BUSINESS PARK OF LEE AND SUMTER COUNTIES SO AS TO ENLARGE THE PARK; AND OTHER RELATED MATTERS

Mr. Watkins said this was the fee agreement associated with the solar farm with Southern Current, and this requirement would apply to each of the six properties.

He said this was a $101 million investment with a five year investment. He said the six sites were located as such:  two are located between Bishopville and interstate on Hwy. 341; one is located off of Highway 15 towards Darlington; three are located below Highway 401 towards Lynchburg.

Mr. Watkins said the annualized fee payment was $282,000 for years 1-10, which is great for the budget and $246,000 for years 11-30. He said this would be divided by the school and the county, based on the percentage of counties’ total millage for each.  He said the company must achieve 90% of total investment for five years or there will be a tax liability.

Councilman Beasley made the motion to approve for third and final reading. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

BID AWARD FOR DOCS DRIVE PROJECT

Mr. Watkins said this was the road that the Pee Dee Math & Science Academy was located on.

He said that the County has worked with the engineers to get easement from SCDOT. He said the County received six bids and the low bid was Furr Grading at $264,000, which includes installing storm drainage and paving.  Mr. Watkins said the funding for this project would come from C Funds.

Councilman Fountain made the motion to approve the bid award for Docs Drive Project. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPROVAL FOR A RESOLUTION FOR THE COUNTY TO PARTICIPATE IN THE LEGAL ACTION REGARDING THE OPIOID EPIDEMIC

Mr. Watkins said there has been public awareness of the opioid epidemic in the state. He said that Representative Will Wheeler, along with Senator Vincent Sheheen, will be working with national law firm and plan to file an action in the state court.  He said there would be no cost to the county and it would be a contingency based lawsuit.  He said the county’s only obligation

would be to come up with estimate on how much it has cost the county to deal with this drug problem and the data proving this.

Councilperson Josey made the motion to approve the Resolution for the County to participate in the legal action regarding the Opioid Epidemic. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried. All voted in favor.

Vice-Chairman Eckley said that he had received information in regards to the post office and said that the design has been completed and the construction would be complete in about 2-3 months. He said the post office should be operational by June 15.

He also reported that Crowne Laundry would be holding its ribbon cutting on February 28. He said that by March 1, they should have 110 employees. He also reported that their goal is 150 employees within 36 months.

Councilman Addison said in reference to the post office, that the public needs to be involved and in touch with our legislature.

Vice-Chairman Eckley said that work has been started on the Ashwood dam.

  1. PUBLIC SAFETY

Councilperson Caughman said that her committee met on January 18 in reference to concerns brought to the committee by David Frantzis regarding the chaining of animals. She said that it would be a cost to the public and would not be implementing new ordinance at this time.  She said it would put too big of a burden on the county.

Sheriff Simon said that the state is considering a new bill. Mr. Watkins said there are laws in place to care for animals and there are restrictions are in place regarding chaining.

Fire Chief Mike Bedenbaugh said that for the last six months of 2017, they responded to 497 calls and have responded to 117 calls to date.

Chairman Windham asked Chief Bedenbaugh about replacing signs and posts and said the County should maybe install cameras for repeated incidences.

Chief Bedenbaugh said that it averages $50 per sign and Chairman Windham asked Chief Bedenbaugh to make a recommendation to the committee about camera installation.

Tim DuBose said that the 911 center has received over 65,000 calls for 2017. He said that EMS responded to 4,998 calls for 2017.

He reported that Lynchburg would be having a Health Fair on March 3, 2018. He said that EMS was fully staffed at this time.

Thaddeus Dickey gave a report and said that registration for T-Ball, baseball and softball was in full swing. He also said that Parks and Recreation would be participating in the Special Olympics again this year.

Councilman Addison said that transportation is doing well and that ridership is good and emphasized that the rides are free.

Councilman Fountain said that his committee did not meet. He said that departments are staying within their budgets.

Chairman Windham said that there would be a Needs Assessment Public Hearing held by Santee Lynches on February 22 at 6:00 at the courthouse.

  1. ADMINISTRATOR’S REPORT

Mr. Watkins briefed everyone the 2020 Census and said the County is already in the process of gathering information.

He also said that he would be sending out budget packets to departments and outside agencies within the next month.

Kyle Kelly reiterated that the 2020 Census is very important to the County and said that the census is worth $1500 per person per year for the count of the county.

Sheriff Simon said that his department had received a $5000 grant from Sheriff Leon Lott in regards to young people practicing abstinence.

He said that crime is low at this time, but still have break-ins taking place.

PUBLIC COMMENT

David Frantzis said that he wanted to find out what he should do to get a bill passed. He said that he may do a petition to get signatures to get an ordinance passed but didn’t want to do that.

Chairman Windham said he would get with committee and write a letter giving Mr. Frantzis some direction as to what he needs to do.
