Members present were Travis Windham, Chairman; David Addison, member; Charles A. Beasley, member; Jackie Josey, member; Johnette Caughman. PUBLIC HEARING

 AUTHORIZING THE EXECUTION AND DELIVERY OF AN INCENTIVE AND CONVEYANCE OF PROPERTY AGREEMENT AMONG LEE COUNTY, CITY OF BISHOPVILLE, AND PROJECT TIDE: A FEE IN LIEU OF AD VALOREM TAXES, AGREEMENT BETWEEN LEE COUNTY AND PROJECT TIDE; THE TRANSFER OF REAL PROPERTY LOCATED IN LEE COUNTY TO PROJECT TIDE AND THE PROVISION OF OTHER INCENTIVES FOR PROJECT TIDE;THE INCLUSION OF THE REAL PROPERTY LOCATED IN LEE COUNTY IN A MULTI-COUNTY INDUSTRIAL PARK WITH SUMTER COUNTY; THE EXECUTION AND DELIVERY OF DOCUMENTS NECESSARY TO AFFECT THE INTENT OF THIS ORDINANCE; AND OTHER RELATED MATTERS.

The public hearing was opened at 9:00 a.m. on a motion made by Councilman Addison, seconded by Councilperson Josey.

Mr. Watkins said that this was Project Tide, otherwise known as Crowne Laundry Commercial Laundry. He said they will be located in the spec building in the Industrial Park, and the county has been working with them for over a year now.  He referred to a handout which listed the general terms of the agreement between Crown and Lee County.  (See attached Exhibit A)

He said the Council needed to pull third reading until the City of Bishopville has final reading, which will be on March 23.

Chairman Windham said that this company visited 18 locations, and it came down to Lee County and North Carolina. He said we were chosen because of our interstate access.  He said the total payroll will be over $4 million per year and this would create a lot of wealth in the community.

PUBLIC COMMENT

Frank Millican – expressed concern about the timing of the public hearing and said that the Council is having these hearings at this time to reduce public participation.

Debbie Tindal – asked when this industry is starting. Mr. Watkins said late fall to beginning of next year.

Pat Carter – she said the County keeps bringing in industry and continuing to give tax breaks, and we are allowing them to make a profit on the backs of the citizens. She had concerns that in the future, things will be robotic and employees will be phased out and does not see what this benefits.

Chairman Windham said if we didn’t give credits, the industry would go to another county. He said we will have 153 jobs and help other business here.

Pat Carter asked what kind of business it is. Mr. Watkins said Crown Healthcare Laundry Service is a commercial laundry business.  Ms. Carter asked if laundry would be done like this in the future.  Mr. Watkins said that she was asking him to determine the future.  Mr. Watkins said the County is negotiating against other counties and this was the best deal that the industry would locate here.  Mr. Watkins said there were claw backs in the contract to protect the County.

Mr. Watkins said that the pay would be $11-16 per hour and would offer health benefits and it would be a union operation.

Mr. Watkins said that we are operating on what we know today.

The public hearing was closed at 9:53 on motion made by Councilman Beasley, seconded by Councilperson Caughman. Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON ADOPTION OF RECOMMENDED AGENDA

Mr. Watkins said that Item 4, which was third reading approval of ordinance for Crowne Industries, should be removed from the agenda because the County was waiting for more information from the attorneys. He said that the addition of First Reading approval of ordinance authorizing Lee County Election Commission to conduct Lynchburg election.

Mr. Watkins also said that Item 5B should be added to include a Resolution regarding the regulating the state pension plan for small counties. Mr. Watkins also said that 5C should be added to include the acceptance of grant from the state for upfit of building at South Atlantic Canners.

Councilperson Josey made the motion to approve the agenda with the noted changes. Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON ADOPTION OF MINUTES FROM REGULAR MEETING OF FEBRUARY 14, 2017 AND CALLED MEETING MINUTES OF FEBRUARY 28, 2017

Councilperson Caughman made the motion to approve the minutes as mailed. Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON ADOPTION OF FIRST READING APPROVAL OF ORDINANCE

 AUTHORITY FOR THE LEE COUNTY REGISTRATION AND ELECTIONS COMMISSION TO CONDUCT THE TOWN OF LYNCHBURG MUNICIPAL ELECTIONS

Mr. Watkins said he got a call Friday morning from the Mayor of Lynchburg saying they had completed two readings. He said he spoke with Stan Barnhill, and they are in agreement.  He said the Town of Lynchburg will reimburse for the cost of the election, which is in June.

Councilperson Josey made the motion to approve for first reading approval. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

PROCLAMATION RECOGNIZING WILLIAM LYDE BRYANT

Chairman Windham stated that he was recognizing William Lide Bryant, although he had never met him, he had always heard great things about him. He then recognized Judy Bryant Alderman, the daughter of William Lide Bryant.  He then presented her with the Proclamation commemorating the 60th Anniversary of the William Lide Bryant building.

Chairman Windham said that Mrs. Alderman has been very generous with monetary donations for the facelift of the building. She has been committed to making the building look better.

  1. PROCLAMATION TO EXPRESS CONCERN OVER THE FISCAL IMPACT OF H3276 ON SMALLER COUNTIES OF THE STATE OF SOUTH CAROLINA

Mr. Watkins read the proclamation and said that 11% of employees’ salaries goes to the state pension plan and said it will climb to 13% and will continue to increase. He said the county can only go up so much to cover these expenses

Councilperson Josey made the motion to approve the proclamation expressing concern over the fiscal impact of the state retirement system. Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.
APPROVAL OF GRANT FROM SOUTH CAROLINA COORDINATING COUNCIL FOR ECONOMIC DEVELOPMENT

Mr. Watkins said that South Atlantic Canners had applied for a grant through the South Carolina Coordinating Council for Economic Development in the amount of $75,000 for the purpose of upfit to the building to assist South Atlantic Canners’ expansion.

The grant authorizes Alan Watkins to sign agreement to draw down funds.

Councilman Beasley made the motion to approve the grant from Department of Commerce for $75,000. Councilman Addison seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

AWARD OF FENCING CONTRACT FOR LEE COUNTY ANIMAL SHELTER

Mr. Watkins said the animal shelter has been under construction for some time and said the fencing was not included. He said the County was going to use a USDA grant in the amount of $50,000 to pay for the fence.  He said these funds could also be used for security cameras, computers, etc.

Mr. Watkins said that he obtained four quotes on the fencing, and ABC Fencing was selected with a quote of $26,248.13 and this quote was submitted to USDA.

Councilperson Caughman made the motion to approve the fencing contract for the Lee County Animal Shelter. Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REAPPOINTMENT OF THREE MEMBERS TO THE LEE COUNTY DISABILTIES AND SPECIAL NEEDS, WITH TERMS BEGINNING IN JUNE, 2017 AND EXPIRING IN JUNE, 2021

Councilperson Josey made the motion to approve the reappointments of the three members to the Lee County Disabilities and Special Needs Board. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

COMMITTEE REPORTS

  1. HEALTH, EDUCATION & WELFARE

Councilperson Josey recognized Andre Laws, mayor of Lynchburg and welcomed him to the meeting.

  1. PLANNING, TAXES & PERSONNEL

Councilman Beasley said that he had no meetings this month. He said that he still encouraged everyone to send letter to the delegation to supply the local government fund at the full amount.

  1. BUILDINGS, LAND & PROPERTY

Vice-Chairman Eckley not here.

  1. PUBLIC SAFETY

Councilperson Caughman recognized Mike Bedenbaugh to introduce some members of the Red Cross.

Josh Stout said that he was thankful for the relationship and partnership that the Red Cross has had with Lee County Fire Department. He said that on January 5, 2016, a family of six escaped from a fire because of the education and smoke alarms that the Lee County Fire Department had installed.  Josh Stout then presented Mr. Bedenbaugh with a plaque recognizing his efforts of service to the community.

Mr. Bedenbaugh thanked the Red Cross for the plaque and said that he was also thankful for the working relationship that they had with them.

He reported that the Fire Department had responded to 220 calls so far this month.

  1. RECREATION AND PUBLIC RELATIONS

Councilman Addison recognized Thaddeus Dickey to give a report. Mr. Dickey said he was finishing up basketball and starting baseball next week.  He said they had seniors walking at the gym and playing bingo on Mondays and Wednesdays.  He said they may start some short trips for seniors soon.

Councilman Addison said that RTA was trying to get a route to Sumter on Wednesday and would continue the Lynchburg route.

  1. ADMINISTRATOR’S REPORT

Mr. Watkins said that he had distributed budget packets and would get them back within 30 days.

He said that met with Gregg McCutchen, Randy Wilson, Mike Deas and Freddie DuBose in regards to submitting a grant through Rural Infrastructure and EDA to enhance the wastewater capacity. He said that Crowne Industries will have a large impact on the wastewater capacity.  He said they will submit a $1 million grant application to increase the wastewater capacity.  He said the capacity is now 75,000 gallons per day and Crowne Industries will use that.

He said that the bids for the parking lot at the old Bishopville High School are due next Tuesday, March 21. He said that 40 parking spaces will be provided with covered walkways.

Councilman Addison said that he visits the majority of parks but he does not report at meetings but does keep notes on anything that needs to be done.

Chairman Windham recognized Michael Davis and welcomed him to the meeting.

PUBLIC COMMENT

Frank Millican asked for a copy of the FILO agreement for South Atlantic Canners.

REQUEST FOR MOTION ON FIRST READING APPROVAL OF ORDINANCE

 PROPOSED MAP AMENDMENT TO REZONE TMP 037-00-00-006 OWNED BY ROBERT B HILTON FROM A GENERAL COMMERCIAL (GC) TO RURAL DISTRICT (RU)

Mr. Watkins said that the Council had received this request from the Planning Commission. He said this property was located between City of Bishopville and Exit 120.  He said that a solar company was looking to locate solar panels in this location. Mr. Watkins said that Leslie Williams was present to answer any questions about the solar farms.

Councilman Addison asked if there were any guidelines about locating these solar panels in a residential area and asked how close these should be placed to a residence. Ms. Williams said there is no restriction in placement because they pose no danger.

Councilman Addison said that he had read on the internet about health dangers about solar panels. Ms. Williams said they do not pose any health risks and she had reports to back up this information.

Chairman Windham said that Arlene Samuels would be at the next meeting representing Planning and Zoning and there would be two more readings and a public hearing.

Ms. Williams said that neighbors had the opportunity to attend a workshop in September to have questions answered.

Chairman Windham said that the Council would make sure that all questions were answered.

Councilman Beasley made the motion to approve for first reading. Councilman Addison seconded the motion.  Chairman Windham called for the vote, and Councilman Addison opposed the vote, but all six other members of Council were in favor.

  1. TRANSFER OF DEED OF OLD ANIMAL SHELTER TO ORIGINAL PROPERTY OWNER, NAMELY, W. C. SCARBOROUGH

Mr. Watkins said this was property that W. C. Scarborough actually gave to the county for the old Animal Shelter. It stated in the contract that if it ever ceased to be an animal shelter, then it would go back to the owner.  The County is doing a quick claim deed which will give property back to W. C. Scarborough to do with what he pleases.

Councilman Fountain made the motion to approve for first reading. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

ORDINANCE AUTHORIZING PURSUANT TO TITLE 12, CHAPTER 44 OF THE CODE OF LAWS OF SOUTH CAROLINA 1976, AS AMENDED, THE EXECUTION AND DELIVERY OF FEE-IN-LIEU OF AD VALOREM TAXES AGREEMENTS BY AND BETWEEN LEE COUNTY, SOUTH CAROLINA AND CERTAIN COMPANIES AS SPONSOR AND SPONSOR AFFILIATE, RESPECTIVELY, IDENTIFIED COLLECTIVELY FOR THE TIME BEING AS PROJECT LYCHEE, TO PROVIDE FOR FEE-IN-LIEU OF AD VALOREM TAXES INCENTIVES AND CERTAIN SPECIAL SOURCE REVENUE CREDITS; AND TO MODIFY A JOINT INDUSTRIAL AND BUSINESS PARK OF LEE AND SUMTER COUNTIES SO AS TO ENLARGE THE PARK; AND OTHER RELATED MATTERS

Mr. Watkins this is in regards to Project Lychee, which had to do with the solar farm. He said the public hearing would be held on January 9, and an ad would run in the local paper.

Mr. Watkins said this was a $100 million investment, and these solar farms would be located on six different sites within the county, four of which do not need zoning changes. He said currently, the use for solar is by special exception.

Mr. Watkins said that solar energy does not cause detriment for infrastructure. He said this facility would stand alone and be a substantial amount of tax revenue possible for county.

Councilman Addison said he would love to see the benefits on behalf of the citizens. He said there should be some sort of classes to make citizens aware of the dangers or benefits to the citizens.

Councilman Addison said that it seems like he was against solar energy but said his concern was the people. He said that he had been doing a lot of reading and he needs to know what’s right and wrong.

Councilman Beasley made the motion to approve the ordinance for first reading. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON THIRD READING APPROVAL OF ORDINANCE

  1. LEASE AGREEMENT BETWEEN LEE COUNTY AND DON BROWN FOR CONSTRUCTION OF AIR HANGAR AT LEE COUNTY AIRPORT

Mr. Watkins said that Mr. Brown owned a plane that was larger than our hangar. He said that Mr. Brown wanted to build a 50 x 50 hangar, and this agreement would allow him to build on airport property and he would pay no rent for 20 years.

Mr. Watkins said that this would be the eighth plane located at the airport.

Vice-Chairman Eckley made the motion to approve for third reading approval of ordinance. Councilman Fountain seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPOINTMENT OF CARL PARROTT TO THE BOARD OF ZONING APPEALS

Councilperson Josey made the motion to appoint Carl Parrott the Board of Zoning Appeals. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPOINTMENT OF RANDY BURNS TO THE LEE COUNTY LIBRARY BOARD

Councilperson Caughman made the motion to approve the appointment of Randy Burns to the Lee County Library Board. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPOINTMENT OF MILDRED WELLS TO LEE COUNTY LIBRARY BOARD FOR DISTRICT 6

            Councilman Beasley made the motion to appoint Mildred Wells to the Lee County                        Library Board to represent District 6.  Councilperson Josey seconded the motion.

Chairman Windham called for the vote, and motion carried.  All voted in favor.

COMMITTEE REPORTS

 HEALTH, EDUCATION AND WELFARE

Dr. Andrews was present and gave update on current events for the school. She said the school had been awarded $1 million for a technology center, which will be located in the current Bishopville Primary school on Roland Street.  She also made everyone aware that Governor Henry McMaster would be at the school on December 22.

Debbie Tindal introduced Joe Perry with Job Corps, and he explained the benefits with his organization.

Councilperson Josey made everyone aware of fomer Chief Justice Ernest Finney’s passing.

  1. PLANNING, TAXES & PERSONNEL

Councilman Beasley said his committee did not have any meetings. He did say that the County was able to have a Thanksgiving Dinner and a Christmas bonus for the employees.

  1. BUILDINGS, LAND & PROPERTY

Vice-Chairman Eckley said that work had been finished on the courthouse windows. He said the 99% of the work had been completed on the parking lot and awning at old Bishopville High School.

He said that Crowne Laundry has hired 60 people and they are training before they become fully operational.

Councilperson Caughman said she did not have any meetings.

  1. RECREATION AND PUBLIC RELATIONS

Mr. Watkins said that Thaddeus was not present because he was attending a meeting. He said that basketball registration was complete.  He said that ballfields look great.  He said that he had positive comments on the new lighting at the old Bishopville High School.

Chairman Windham said there may be some memorabilia inside gym regarding past championship games.

Councilman Fountain said that he did not have any meetings. Everyone is staying within their budgets.

Mr. Watkins said that County should be receiving audit after the first of the year.

  1. ADMINISTRATOR’S REPORT

Mr. Watkins made everyone aware that a portrait of James Davis was placed in the courtroom and said this was done by Lee County Bar Association. He also said the Census will be here soon and we will have planning session to get a better count.

PUBLIC COMMENT

David Frantcis was present and was interested in the county doing an ordinance prohibiting chaining dogs in Lee County.

Chairman Windham directed him to talk to Sheriff Simon and said he would put in committee.

Carrie Gass asked for an update on Ashwood Lake. Mr. Watkins said that a permit has been put out for bid.  Dr. Andrews said she did not have an update and said that DNR was supposed to be providing the funding.

Vice-Chairman Eckley said the census has dropped by 8.2% from 2010 to 2016.

REQUEST FOR MOTION ON ADOPTION OF MINUTES FROM OCTOBER 10, 2017 AND CALLED MEETING MINUTES OF OCTOBER 17, 2017

 Vice-Chairman Eckley made the motion to approve the minutes from the regular meeting of October 10, 2017 and called meeting minutes of October 17, 2017. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON ADOPTION OF SECOND READING APPROVAL OF ORDINANCE

 CONSTRUCTION OF HANGER AT LEE COUNTY AIRPORT

Mr. Watkins said that the Airport Commission brought this to his attention. He said that the County had been working on getting 10 based aircraft to receive federal funding.

He said that unless you have 10 based aircraft, you are not eligible for funding. He said that currently the county has eight hangers on site and there was one from the previous year.  Mr. Watkins said that Don Brown has a twin engine plane and wanted to construct a hanger that would house the plane.

Mr. Watkins said that the County would do a lease purchase contract and Mr. Brown will pay for the construction of the hanger. Mr. Watkins said that he would not pay rent for 20 years.

Mr. Watkins said that the County wanted to have 20% of the proceeds from the FILO agreements to go towards economic development. He said that 20% of the FILO for Crowne Industries and SAC would go towards economic development.

Councilman Beasley made the motion to approve for second reading approval. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

BETTYE SCOTT AND LOTTIE JONES, OF LEE COUNTY TRANSPORTATION, WILL PROVIDE AN UPDATE TO COUNCIL ON TRANSPORTATION IN LEE COUNTY

Bettye Scott thanked the Council and County for everything they had done. She said that transportation is on the move because of the county.

Lottie Jones thanked the Council for their support. She said that trips are constantly increasing and have really increased over a year.

She said that Bettye Scott was awarded and did a presentation in Nebraska, and they wanted to know how Lee County made its transportation system successful. She said that Lee County has a lot to proud of in its accomplishments.

Bettye Scott said that the state of Virginia has asked Lee County to assist them in transportation endeavors, but due to health reasons, she would not be able to go.

APPROVAL TO APPOINT TERRY HERIOT TO THE LEE COUNTY PLANNING COMMISSION FOR DISTRICT 7

Mr. Watkins said Mr. Heriot would be replacing Artis Graham. Councilperson Josey made the motion to approve the appointment.  Councilman Addison seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPROVAL OF THE REAPPOINTMENT OF JAMES STOKES TO THE LEE COUNTY PLANNING COMMISSION FOR DISTRICT 1

Chairman Windham said this was his appointment, and Mr. Stokes had done a great job. Councilman Beasley made the motion to approve the reappointment of James Stokes to the Lee County Planning Commission for District 1.  Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried. All voted in favor.

APPROVAL OF THE APPOINTMENTS OF ARLENE SAMUELS AND KAY FARMER TO THE LEE COUNTY DISABILTIES AND SPECIAL NEEDS BOARD, FOR A FOUR TERM AND A TWO YEAR TERM, RESPECTIVELY.

Councilman Addison said that he had a correction to make. It was said that our senator (Malloy) did not return the call, but he did return the call and Mr. Addison did not answer.

Councilman Beasley asked Thaddeus to update on Woodrow Park. He said the signage was up and the ribbon cutting would probably be in a month.

Mr. Watkins said that he attended a strategic planning session at the COG.   He said they had hired a new director, Chris McKinney, and he was on the interview committee.  Mr. Watkins said he is going to do a good job.

He said he will be giving Mr. McKinney a tour of Lee County in December.

He said he attended an Administrator’s Meeting and said it was a good meeting.

REQUEST FOR MOTION ON ADOPTION OF FIRST READING APPROVAL OF ORDINANCE

 CONSTRUCTION OF HANGER AT THE LEE COUNTY AIRPORT

Mr. Watkins said this matter has been discussed previously in the Buildings, Land and Property Committee. He said the County currently has nine hangers.  Mr. Watkins said this would the county’s tenth hanger on site.  He said that Don Brown is the person wanting to construct the hanger.  He said he owns a twin engine plane that will not fit into the existing hanger.  Mr. Watkins said he wants to build a 50×50 hanger.  He said the county will not charge him rent for 20 years, and after that time, the county would own it.

Councilperson Josey asked in the event that airports folds, where does the county stand. Mr. Watkins said that Don Brown is leasing space from us.  He said that he would have to research to determine what the county’s position would be if the airports folds its operation.

Councilman Addison asked if there is a contract between Lee County and Don Brown. Mr. Watkins said that we are in the process of preparing a contract now.

  1. ALLOCATION OF FILO TAX COLLECTION FOR SOME PROPERTY LOCATED IN THE COUNTY

Mr. Watkins said the County was trying to establish a stream of revenue of our two parks. He said that the county had discussed the possibility of if the county had new FILOs, then they would take 20% and put it aside to go towards economic development.  He said, for example, South Atlantic Canners and Crowne Industries are two new FILOs.  He said this would allow the county to take 20% and restrict those funds for economic development.  He said the total FILO for the SAC expansion is $104,000.  He said that 20% of that would be 20,000 that could be set aside for economic development.

Councilman Beasley made the motion to approve for first reading. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON ADOPTION OF SECOND READING APPROVAL OF ORDINANCE

Mr. Watkins said that a person would have to meet the qualifications and appear before the Board of Zoning Appeals. He said this facility would be located on Back Swamp Road.  He also said that it would be regulated by DHEC and was a seasonal facility.

  1. APPROVAL OF CONTRACT FOR SUMTER/LEE DETENTION CENTER

Mr. Watkins said this does not change the contract itself and does not anticipate an increase in the budget. He said this contract can be terminated in 90 days and the budgets would remain separate.

Councilman Beasley made the motion to approve for third and final reading. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried. All voted in favor.

  1. PURCHASE OF EXCAVATOR AND BACKHOE FOR PUBLIC WORKS

Mr. Watkins said this had been discussed previously in committee and the decision had been made to purchase this equipment. He said the excavator was needed to clear ditches.  He also said the county was also trading in the backhoe for this new one.  Mr. Watkins said the total cost for these purchases was $166,583.  He said the County would pay 50-75% of the cost upfront and finance the remaining balance over a three year period.  He said these funds would come from the road maintenance fees.

Mr. Watkins said that he received a request on July 19 from the Lee County Planning Commission to make zoning adjustment. He said this is a seasonal operation.  He also said

there would be guidelines put in place that a person would have to meet before a Deer Processing operation could be done. (See Attached List).

Councilman Addison asked if this type of operation would come under DHEC. Ms. Arlene Samuel said that DHEC could come in and check at any time.

Carrie Gass asked with a special exception can anyone who applies for this have to go through this process. Mr. Watkins said that Council was not approving it this morning but setting up the process.  He said that if Council puts into place as a special exception, a person would have to go before the Board of Zoning Appeals.

Mrs. Gass asked if a specific person had applied for a deer processing operation. Mr. Watkins said a person in Lynchburg had applied.  The operation would be located off of Backswamp Road.

Chairman Windham said there is only one deer processing operation in the County and it is located in the Wysacky area, and it is located less than 200 feet of houses.

Mr. Watkins said he received this request from Darlington County as a result of an announcement of a new industry there. He explained that if a new industry locates in a multi-county park, there are tax incentives for that industry locating there.  He said this would give the County additional revenue coming in and the amendment would also lengthen the term of the agreement to 40 years.

Councilperson Josey asked if Lee County owned this property. Mr. Watkins said that this was a process of the FILO agreement between the Counties and Lee County would receive 1% of fee proceeds.

He said that Sheriff Anthony Dennis approached Sumter County about taking over facility.  He said we are doing contract with Sheriff Dennis, who will be responsible for day to day activities.  Mr. Watkins said that the budgets will be kept separate, and the contract will be renewable at each election in case there is a new sheriff elected.  Mr. Watkins said there should be no cost increase and said the County is basically moving this under Sheriff Dennis.  He said it is basically a savings to the County not to have to operate a jail.

Councilperson Josey made the motion to approve the contract for Sumter/Lee Detention Center. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

  1. PURCHASE OF EXCAVATOR AND BACKHOE FOR PUBLIC WORKS

Mr. Watkins said there has been discussion through the Buildings, Land & Property Committee and we are now moving forward with the purchase of this equipment. He said that the total for the excavator, backhoe and trailer after the trade in of the current backhoe is $230,206.72.  Mr. Watkins said the recommendation from the Committee is to pay a portion of the total cost up front with the funds from the $15 Road Maintenance Fee, and finance the balance for 36 months as John Deere currently has 0% interest rate for new equipment for 36 months.  He said this would allow the County to retain a healthy surplus in the Road Maintenance account to meet short term needs in the event of an emergency.

Vice-Chairman Eckley made the motion to approve for second reading. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

Thaddeus Dickey said that he has received great compliments on the parking lot. He said that football will be done in two weeks.

Mr. Watkins said that awnings will go across front of building and will be installed in early November. He said the flag pole will be relocated to a more visible area.  The County is working with Pilot Club for the installation of memorial bricks.  A ribbon cutting should be done in mid November.

Councilman Addison mentioned that the kids are using the railing of the stairs for a play area and encouraged parents to correct their children.

Carrie Gass – regarding healthcare, asked if there was anything the County could do to replace dentist and doctor here in Lee County. She said there is a dentist that will be operating out of the office on Harris Street and it will be a children’s dentist.

She also made everyone aware of a fundraiser that will take place on October 21 for Dennis High School.

REQUEST FOR MOTION ON ADOPTION OF FIRST READING APPROVAL OF ORDINANCE

 APPROVAL OF CONTRACT FOR SUMTER LEE DETENTION CENTER

Mr. Watkins said that this update is in reference to overall management of the Detention Center. Since the inception of opening, the center has had a director, namely, Simon Major, who has retired.  With that, Sheriff Anthony Dennis approached Sumter County and asked to manage the detention center.  Both counties have agreed to a contractual agreement with the Sheriff.  Sumter County has approximately 90% interest and Lee County has approximately 10% interest in detention center.

Mr. Watkins said there will be no change in the dollar amount we give to the jail and there would also be a clause that would allow a 90 days to break the contract if needed.   He said that the County would have to do three readings to approve the contract.

Mr. Watkins said the staff would report to Sheriff Anthony Dennis, and the detention budget would be separate from his operating budget. He also said the County is still operating off of the old contract.

Councilperson Josey made the motion to approve the contract for Sumter Lee Detention Center. Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried. All voted in favor.

Mr. Watkins said that he met with Buildings, Land & Property to review this matter, and noted that it was included in the budget for this year. He said they got quotes from several vendors but decided to purchase a John Deere excavator.  He said that it was not the least expensive, but the resale value is better, and it was on state purchase discount. He said the total cost was $166,583.

He said that based on flooding issues, the County has some ditching that needs to be done, and this equipment is greatly needed to do this. Mr. Watkins said the County will use the $15 road maintenance fee, and currently, there is a surplus in that account.

Mr. Watkins said the total cost is $166,583, in which the County will play 25-50% up front from existing dollars on hand and will probably finance the remaining balance.

Mr. Watkins said that he will have final recommendations before the third reading.

Councilman Fountain made the motion to approve for first reading.   Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON ADOPTION OF THIRD READING APPROVAL OF ORDINANCE

Mr. Watkins said that came about as a result of an economic development opportunity in Lynchburg. He said their Planning Commission is not fully staffed and asked us to authorize the Planning Commission to review this request.  He said the County would also provide consulting and advice as a resource but not make final decisions.  He said the County Planning Commission could hear zoning requests and make recommendations to Lynchburg Town Council.

Councilperson Josey made the motion to approve for third and final reading approval of ordinance. Councilman Addison seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

RESOLUTION AUTHORIZING THE RENEWAL OF CONTRACT WITH ASHBRITT FOR STORM DEBRIS REMOVAL

Mr. Watkins said this was recommended by the State EMD office and we were going by Sumter County’s contract. He said there was no cost up front to us.  Mr. Watkins said they would be our primary vendor.

Councilman Beasley made the motion to approve the resolution authorizing the renewal of contract with Ashbritt for storm debris removal.

Mr. Watkins said the Committee had met regarding the purchase of the excavator. He said that the committee also discussed some Public Works needs over the next 12-24 months.  He said that trash receptacles and roll off trucks were mentioned. Mr. Watkins said that some of those needs will be addressed with the 2018 bond.

Mr. Watkins said the old Bishopville High School parking lot was prepped and ready for asphalt.

  1. PUBLIC SAFETY

Councilperson Caughman not here. Mr. Watkins said the County had 44 calls during the 24 hours we were impacted by the hurricane.  He said there were 700 power outages during the 24 hour period.

Mr. Watkins thanked Public Safety employees for their work during the hurricane and also thanked First Baptist Church for honoring the first responders with a meal.

Chairman Windham told Councilman Addison that it was good to have him back.

Councilman Addison thanked everyone for their thoughts and prayers and said that his wife was doing better.

Thaddeus Dickey said the schools were closed today and football started today. He said that the gym is open from 8 a.m. to 1 p.m. for anyone who wants to walk.

Chairman Windham also asked if things had been finalized on the PARD grant. He said that the legislative delegation had signed it.  He said that county had requested $32,000 but Senator Malloy reduced it to $22,635, which was the amount that the county would lose if not spent.  He gave no reason for reducing the amount on the grant.  There was some discussion about the PARD grant and the deadlines and the communication that had taken place between the legislative delegation.

Councilman Addison said that the transit is still doing good in the county.

He did mention that ditches are still being flooded. Said that people are still complaining.  Mr. Watkins said that the County can only work on county ROW and rocked or dirt roads.  He said that paved roads would come through DOT.

Mr. Watkins said that he received confirmation that I-20 Park has been recertified. He said that both parks have been site certified.  He thanked the LINK staff for their involvement.  He said the county was reimbursed 75%.

Mr. Addison said he received a letter regarding solar energy and asked if there was anywhere in Lee County that was zoned for that. Mr. Watkins said that you can do in a rural district with a special exception.

PUBLIC COMMENT

Carrie Gass said that Dr. Pate’s office is closing and wondered if the elected officials can do anything to help keep his office open here. She also said that the drainage of ditch on East Church Street was still a problem.  She asked about the status of the Ashwood Lake. She also made everyone aware about a fundraiser at the Dennis Community Center.

 Chairman Windham opened the meeting and welcomed everyone. Councilman Beasley gave the invocation and led the Pledge of Allegiance to the flag.

 Councilman Beasley made the motion to approve the agenda as mailed. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON ADOPTION OF FIRST READING APPROVAL OF ORDINANCE

  1. UPDATING AND REVISING THE HOST AGREEMENT WITH THE LEE COUNTY LANDFILL

Mr. Watkins said that there has been a host agreement between the County and the Landfill since the landfill opened in 1990. He said this agreement just outlined the tipping fees, collection rates, etc.  He said there had been several agreements since 1990, and we are just combining all language of all agreements and will be starting over with the terms.  He did say that the county is not going to allow any more garbage into the county and will not be changing the type of garbage that is received.

Mr. Watkins said that an extensive overview will be given at the second reading.

Councilperson Josey made the motion to approve for first reading. Councilman Fountain seconded the motion.  Chairman Windham called for the vote, and motion carried. All voted in favor.

REQUEST FOR MOTION ON THIRD READING APPROVAL OF ORDINANCE

  1. LEE COUNTY BUDGET FY 18

Mr. Watkins gave the Council three budget proposals with different cost of living raises, which were 2% with 1% bonus at Christmas, 1.75% with the 1% at Christmas and 1.50% with 1% at Christmas.

He said that over the next five years, the County’s pension plan would increase by an additional $300,000 and Council needed to decide how to proceed with the budget. He said that the Ways and Means had also approved a tax millage increase of 1.5%, which would generate $48,000 and the school would have a 1.7 mill increase.  Mr. Watkins reminded everyone that school millage increase would not affect the 4% property taxes but would on 6% property, or rental property.

Chairman Windham said that it concerned him that the County would have to face these increases over the next five years and recommended the 1.50% with the 1% at Christmas.

Councilman Fountain said that the County should get ready for the future.

Councilman Beasley said that if everyone wanted to go with the 1.50% with the 1% at Christmas, he would go with that, but he would really like to be able to give the 2%.

Councilperson Josey said the 2% would really help employees but said she would go with the 1.50% with the 1% at Christmas.

Mr. Watkins said the total budget FY 18 was $12,404,594. Councilman Fountain made the motion to approve for third and final reading.  Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

  1. LEE COUNTY SCHOOL BUDGET FY 18

Mr. Watkins said the school district came to the public hearing and presented the overall budget. He said the Ways and Means Committee was recommending that the maximum millage increase of 1.77 be given for a total of 139.83 mills, which will add a tax revenue of $40,000.

Councilperson Josey made the motion to approve for third reading. Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPROVAL TO ACCEPT A CDBG GRANT ON BEHALF OF KERSHAW/LEE COUNTY TO INSTALL A WATER TOWER IN THE ST CHARLES COMMUNITY

Ms. Sharon Durden, of Santee Lynches, was present to inform Council on the installation of the water tower.

She said that Cassatt Water had contacted them about applying for a grant. She said that the capacities of their daily demand are not being met, and that’s the reason they are needing additional water tower. The grant amount was for $1,152,200 total and the matching funds would be provided by Cassatt Water.  She said that Lee County is the grantee and contracts with Santee Lynches.  She also stated that the County will not be responsible for any money and the COG and Cassatt Water will be responsible for handling the paperwork.

Councilman Beasley made the motion to approve a CDBG grant on behalf of Kershaw/Lee County to install a water tower in the St Charles Community. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

Mr. Watkins said that he had received a request from the COG to facilitate a meeting between City and County for EIS study community involvement process. He said they were to appoint two members to an ad hoc committee and were in the process of coming up with a date.

Senator Tim Scott’s representative, Margaret Smaulding, was also present.

  1. LEE COUNTY BUDGET FY 18

Mr. Watkins said that the current projected revenues were $12,431,531 and the current projected expenditures were $12,449,531, resulting in a current deficit of $18,000.

He said the State finally approved their budget but the County was still waiting on the final numbers, which would have a significant impact on the budget.

Mr. Watkins commented there was a decrease of $6750 in operations and expenditures. He also said there was an increase of $2000 in outside agencies, which was in Council on Aging in their Meals on Wheels operation.

Mr. Watkins said that a purchase of excavator and trailer for transporting the excavator may be recommended in the third reading of the budget due to the fact that the monies to purchase this would be coming as a result of an insurance claim and the sale of a previous motor grader.

He said that new costs to this year’s budget would include the pension plan increase, which was mandated by the Legislation, at an increase of $55,000, and also noted this could be a potential increase to $300,000 or more over the next six years.

Mr. Watkins also said there was an increase on Workers Compensation of $30,000, due to a couple of major claims in the last year.

He said that C Fund Allocation for rocking of roads increased to $150,000 and a 2% cost of living and 1% Christmas bonus for employees was included at $210,000.

There was also revenue adjustments at $323,000.

Mr. Watkins said the Ways and Means Committee was recommending a 1.5 Mill Tax increase to help address the pension costs from the State Legislature requiring additional funding from employers to address long term gap in the funding required to meet the full pension plan long term liability. The 1.5 Mill Tax Increase will generate an additional $48,000 in revenue.  He said it has been four years since the County has had a tax increase, and they did not increase the maximum amount of 2 mills.

Vice-Chairman Eckley made the motion to close the public hearing at 5:50 p.m., followed by a second by Councilman Beasley. Chairman Windham called for the vote, and motion carried.  All voted in favor.

Councilperson Josey made the motion to open the public hearing at 5:51 p.m., seconded by Councilman Beasley.

Mr. Watkins said the school had asked for a tax increase of 1.28% to 139.83 mills at first reading.

Mr. Bernard McDaniel said that Dr. Andrews was not able to attend the meeting.

Mr. Watkins said the school district is dealing with the same issues as county in regards to retirement and pension costs.

Mr. Watkins said the cap is a formula, and is computed on a population basis, or CPI. He said that no additional millage applied because population is declining, so the current CPI of 1.28 is multiplied by current millage of 138.06 equates to 1.77 total number of mills.  He said the Council has the authority to add maximum of new funding as taxation.

Councilman Beasley asked if the school’s pension fell under the same as County’s and also asked if the school would be having an increase in insurance premiums effective January 2018.

PUBLIC COMMENT

Lyde Graham said that the school district would have 1.6 million in the budget, if they were getting the funding in the books, referring to the Education Finance Act.

APPROVAL OF PURCHASE OF E-911 EQUIPMENT UPGRADE

Mr. Watkins said that Public Safety met on this. He said that the 911 system dispatched fire, police and EMS with computer system and phone and said the life expectancy of the equipment is running out. He said that the purchase of this new equipment would be paid for by the E911 surcharge, and the cost amount of the equipment would be approximately $475,000.

Councilman Beasley said that his committee did not have any meetings. He did say that in approving the budget he thought the Ways and Means Committee did well by the county employees.  He also said that he attended the Walk a Thon at the Mary McLeod Bethune Park and said it was well attended.

Vice-Chairman Eckley said that his committee had no meetings, but work continued on the windows on the courthouse.

Councilperson Caughman said that her committee did meet on the E911 upgrade and said this was well needed and will serve the county well.

Mr. Watkins said that they have completed the baseball season and will be offering summer camps and working with Boys and Girls Club. He also said there was a contractor lined for the parking lot for the old Bishopville High School.

Councilperson Caughman said she sponsored a baseball team and encouraged people to do the same.

Myoecenia Wells said that more signs on the interstate were needed to recruit more business downtown.

REQUEST FOR MOTION ON ADOPTION OF FIRST READING APPROVAL OF ORDINANCE

 LEE COUNTY BUDGET FY 18

Mr. Watkins said this was in name only and the Ways and Means Committee still had some work to do to present a balanced budget. He said the total budget figure was $12,603,166.35.  He said the proposed revenue was $12,213.412, which presented a deficit of $389,754.35.

Mr. Watkins said there were several increases over last year’s budget, including the state’s increase in pension plans, which will have a great impact on the counties. (See attached handout for greater detail). He said the budget would be balanced by the third reading, and the public hearing would be held on June 13, 2017.

Councilman Fountain made the motion to approve the Lee County Budget FY 18 for first reading approval. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

  1. LEE COUNTY SCHOOL BUDGET FY 18

Mr. Watkins said he received a letter from the school district asking us to use the same figures as last year as a starting point but adding the maximum millage rate increase of 1.28% for the first reading. He said this would increase the operational millage for a total of 139.83 mills.

Dr. Andrews said that it was going to be another tough year.

Councilperson Josey made the motion to approve the Lee County School Budget FY 18 for first reading. Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

COMMITTEE REPORTS

  1. HEALTH, EDUCATION AND WELFARE

Councilperson Josey said that she was glad to see School Board members at the meeting.

She recognized Dr. Andrews to update Council on the happenings of the school.

Dr. Andrews handed out a courtesy copy of a newspaper that the students had published. She said they were preparing to close schools for year but some of the schools would be open for summer camps and summer programs.

She introduced Dr. Bertha McCants, who is in charge of grants.

Councilperson Josey said that the Lee County Adult Ed would have their graduation on May 16, and the Middle School graduation would be May 26.

  1. PLANNING, TAXES & PERSONNEL

Councilman Beasley said that his committee had no meetings. He did announce that the NCNW would be having their annual Walk a Thon on Saturday, May 20 at 8 a.m. at Dr. Mary McLeod Bethune Park.

Carrie Gass thanked the Council for their past support of their organization and the park.

Councilman Beasley also added that Brian Bradt had finished the lights on the shelter at the Mary McLeod Bethune Park and Public Works helped trench for wires and this was a savings.

  1. BUILDINGS, LAND & PROPERTY

Vice-Chairman Eckley said that work has continued on the windows of the courthouse. He said the company has removed some of the windows and having them refurbished.  He said that process has several more weeks.

He also reported that a few months ago, the County purchased a new motor grader. He said the County was able to sell the other one for a price of $115,000.

He also made everyone aware that the meeting on the proposed bypass would be held at Lee Central.

  1. PUBLIC SAFETY

Councilperson Caughman said that her committee did not have any meetings. She said that she always enjoyed receiving the newsletter from the school.

She introduced Bill Hemby, who works with bees in the county prison to educate the prisoners and to promote Lee County.

  1. RECREATION AND PUBLIC RELATIONS

Councilman Addison said that he had read the new work plan for Recreation and was going to accept it and see how it works.

Mr. Watkins said that he had worked out a schedule for the concerns that Mr. Addison had, which addressed the roles of Public Works, Parks and Rec, and private contractors. He said that he made sure the expectations are clear and everyone is aware.

Councilman Addison thanked Council and Mr. Watkins for their cooperation.

He said that transportation is still going good. He said there is a new committee that is in the developing stage right now, and he should have some more information on that soon.

Councilperson Josey thanked Public Works and Parks and Rec for the work in preparation for the Magnolia Festival. She said the park was in bad shape and they did a great job in getting park back to where it was.

Councilman Addison also said there was a leak in the Ashwood Gym. Mr. Watkins said that he was aware of it and had a contractor looking at it.

Councilman Beasley asked about the status of the grant for PARD grant and asked if it had been signed off by the delegation.

Mr. Watkins said they submitted another letter and got a letter back from Senator Malloy asking for further discussion. He said the County is following up on that. Mr. Watkins said that the County will lose $23,000 of $24,000 if it is not assigned to a project.  He said the County was

going to follow up again. He said the County has $95,000 in reserve right now, including PARD allocation for next year and will have $30,000 next year. He said that delegation has to sign off on projects.  Mr. Watkins said that Representative Wheeler and one of the two senators has to sign.  He said to date, the County has not obtained two signatures.

Councilman Addison told Mr. Watkins to let them know as a Council what needed to be done. Mr. Watkins said that Council invited Delegation to a committee meeting on two separate occasions.

  1. WAYS AND MEANS

Councilman Fountain said that Ways and Means Committee met with Department Heads and Elected Officials and outside agencies and will have a couple more meetings.

  1. ADMINISTRATOR’S REPORT

Mr. Watkins said that he attended a Pinwheel Ceremony at DSS in recognition for Child Abuse Prevention Month. He said that this is a very difficult job and commended them on their efforts.

He also said that several courthouse employees received their recertification in CPR. Mr. Watkins said the County are updating their AEDs and these will be located on the first and second floors of the courthouse.

Mr. Watkins also said the public hearing for the budget would be on June 13, 2017 at 5:30 p.m. in the Main Court Room.

He also attended a flag park dedication for veterans in Lynchburg.

Chairman Windham said there was a public forum for citizen awareness scheduled for May 23 at Mt. Hermon.

PUBLIC COMMENT

Carrie Gass asked the Council if they were aware that homelessness is a problem here in Lee County and also substandard housing.

She mentioned that it is time for Salkehatchie project, which is scheduled for June 25. She said that its mission is to keep people dry, warm and safe.  She said that although it is good, it can’t help everyone in need.

She asked the Council to search to see if they can a grant to build affordable housing for homeless citizens.

Mr. Watkins said that FEMA has gotten letters in reference to houses for floods of October 2015. Mr. Addison asked if the cleanup crew was still here.  Mr. Watkins said they were gone.

Mr. Addison asked if residents still had trees down, what were they to do. Mr. Watkins said there are faith based groups that are available to help with that.  He said that County cannot go on private property.

UPDATE ON CAPITAL PROJECT: OLD BISHOPVILLE HIGH SCHOOL PARKING LOT AND AWARD OF CONTRACT FOR LOW BID

Mr. Watkins said that the County took over property over two years ago. He said it was put out for bid on SCBO and six contractors came to the bid meeting.  There were two bids submitted, and low bid was $190,957 from Charles Smith Company.  See attachment of breakdown of the budget for this project.

Mr. Watkins said this would be for a 40 space parking lot, covered walkway and a possible metal stairwell. Mr. Watkins added in addition to the work by Charles Smith. The County has received insurance for damage to rec office roof for $44,000.  Council agreed to proceed with Charles Smith as well as other repairs to the building. He said this does not include PARD money.

Councilman Fountain made the motion to approve Charles Smith Company as the low bidder at $190,957. Councilperson Caughman seconded the motion.  Vice-Chairman Eckley called for the vote, and motion carried.  All voted in favor.

Councilperson Caughman asked what the money from the landfill would be used for. Mr. Watkins said there were no projects planned.  He said the County would get $30,000 this year but have to have signatures from the Legislative Delegation.

Councilperson Caughman asked about repairs to the Mental Health building and has anything been done. Mr. Watkins said the County does not charge rent for the building.  He said he would talk to Will Wheeler and Thomas McElveen to see if money can be received from the state.  Mr. Watkins said he would try to get some money in the budget for this.

Councilperson Josey asked Mr. Watkins if a representative from Boeing been to visit Lee County. Mr. Watkins said he thinks someone came last year to visit schools.  Mr. Watkins said he would ask Jay Schwedler to make sure.

Mr. Watkins said that the Town of Lynchburg had authorized the local election board to conduct its elections. He said they had agreed to pay for any cost and the cost estimate given to them by Stan Barnhill was approximately $1500 per election.

Mr. Watkins said this was Crowne Health Laundry Services and would be located in the spec building. He reviewed the incentives and general terms of the agreement, which is included in the attached handout.  He said it was an $11 million investment over a five year time frame to develop a 59,000 square foot facility.

Mr. Watkins said the City of Bishopville agreed to job tax credit that would be equal to the total of the impact fee/153 total jobs, which would equal to $1130 per job tax credit. He said the City would lock in water rate for two years.

Chairman Windham said that Crowne looked at 18 different site and it got down to one other and Lee County. He said that we were fortunate to have been selected.

Vice-Chairman Eckley said that the County was excited about where we have come from in 15 years.

Councilperson Josey introduced Brand Turner, who was standing in for Mr. Favour. He said that April was Child Abuse Prevention month and said that Lee County had dispersed $574,207 in SNAP benefits for the month of March.

Councilperson Josey said that Lee County Adult Education was offering free computer classes from May 1-11 from 5:00 – 8:30 p.m. if anyone was interested.

Councilman Beasley said that his committee did not meet. He said that we still need to work with state to still receive the full Local Government Fund.

Vice-Chairman Eckley said that there was a bid meeting for old Bishopville High School parking lot, and the County was reviewing bids now. He also said that the County would be paving Dusty Lane, and the low bid received was $53,000.  He said they were waiting on application from Tom Drayton.

He said that he attended the celebration with Coke, which was the new $13 million expansion and nine new jobs. He said they would be getting some new equipment too. He said that Coke has been in Lee County for 44 years.

Mr. Watkins also said that everything had been submitted for FEMA in regards to the hurricane.

He said that it looked like a $375,000 increase for the county in pension rates over the next five years. He said that hopefully the state will look at helping the counties to offset these costs.

Chairman Windham said that he attended the Clemson Extension Service Open House in which approximately 50 people attended.  He said that it was a very nice event.

  1. ADMINISTRATOR’S REPORT

Mr. Watkins said that he with Terry Booth, interim president of Central Carolina, recently and she said based on the scholarships we funded, the number of graduates for Lee County was 22%.

He said The Link held a program at the Central Carolina Manufacturing Technology Training Center in Sumter. He said that rising ninth graders were present, as well as their parents, to show what the jobs of the future will look like.

Mr. Watkins commended Erika Williams, of The Link, for the great job she did in coordinating this event and what she has done to help Lee County.

Vice-Chairman Eckley said that he was proud of the students at the meeting.

RDINANCE AUTHORIZING THE EXECUTION AND DELIVERY OF A FEE IN LIEU AGREEMENT BY AND BETWEEN LEE COUNTY, SOUTH CAROLINA AND SOUTH ATLANTIC CANNERS, INC PROVIDING FOR A PAYMENT OF A FEE IN LIEU OF TAXES, THE ISSURANCE OF SPECIAL SOURCE OF REVENUE CREDITS, AND OTHER MATTERS RELATED THERETO.

Mr. Watkins said that the fee agreement would reduce the taxes from 10.5 to 6% for thirty years. He said this was a $14 million investment with nine jobs.  It also involved a SSRC, which is a tax credit of 15% over the next 15 years.

Chairman Windham said there are guidelines that a county can do for an industry to locate here. Mr. Watkins said that it depends on the amount of investment and number of jobs that an industry plans to bring.  He said the jobs that would be created from this expansion would have an average pay of $19 an hour.

Jay Schwedler said Lee County is competing to the best of its ability right now with these recent announcements.

PUBLIC COMMENTS

Thompson Isaac asked how long the FILO would be in effect. Mr. Watkins said that it would remain in effect for 30 years.  He said that this is mostly for upgrading their equipment.

Pat Carter asked how the county can benefit from reducing the taxes of SAC from 10% to 6%. Mr. Watkins said this is a new investment.  He said that in order for SAC to invest $14 million, the County would have to give a tax break, and the county would still net the 6% that it would haven’t had to begin with.  Ms. Carter asked was 9 jobs all they could give to the county for that investment.  Mr. Watkins said that was the number of jobs created by the expansion.

mr. Schwedler said if they don’t continue to make investments, they would tend to lose jobs.

Ms. Carter asked what guarantee does the county have that they are not going to leave anyway. Mr. Watkins said there are no guarantees because they choose to invest.  He said there are some things in the contract to help protect the county.

Dorothy Mills asked what kind of jobs are the new jobs that will be paying an average of $19 an hour. Mr. Watkins said they are production jobs and SAC was possibly adding another shift.

 ZONING TEXT AMENDMENT TO PERMIT A WASTE TIRE PROCESSING FACILITY AS A PERMITTED USE IN A RURAL DISTRICT

The public hearing was opened at 9:44 on a motion made by Councilperson Caughman, seconded by Vice-Chairman Eckley. Chairman Windham called for the vote, and motion carried.  All voted in favor.

Mr. Watkins said that Planning Commission recommended this request to Council, which was received on December 28, 2016.

Mr. Watkins said the request was for a tire processing facility with three stipulations, (1) Cannot be established within one (1) mile of an existing waste tire processing facility (2) Must be screened from public view by the installation of a 6 ft privacy fence. (3) must maintain and follow all guidelines from DHEC.

He said that tires cannot be put on the ground because that is not permitted by DHEC and there would be no burning of tires. He said the tires would be ground up because there is a market for recycled tires or ground up tires.

He said that DHEC would monitor the facility on a weekly basis and tires can only be there for 60 days.

Chairman Windham recommended that the information be reviewed and placed in the Buildings, Land & Property Committee.

Councilman Beasley said to put in some stipulations and saw no reason to put in committee.

Vice-Chairman Eckley asked if they are found not to be in compliance, what can be done. Mr. Watkins said if they are in violation of not being in compliance, they could be fined $200 per day or they could spend up to 30 days in jail.

Public Comment:

Carrie Gass – asked where the facility would be located. Mr. Watkins said the facility in question would be located off of Mary McLeod Bethune Park but said the Council is not really considering the person, but considering a zoning amendment for anyone.

Mr. Watkins then said that Council wants to add a special step to have them appear before the Board of Zoning Appeals.

Pat Carter – said “so, no burning of tires?”.. Mr. Watkins said no. She then asked would it have any effect on the property.  Mr. Watkins said he probably couldn’t answer that.  Not sure if this will have a positive or negative effect.

She asked how many jobs this will bring to the County. Mr. Watkins said he could not answer that.

Ms. Carter asked what benefit this was to the County. Mr. Watkins said this would restrict people on how to use their property.

She asked where they were going to haul the recycled tires. Mr. Watkins said there are companies who use in septic tanks.

Ms. Carter asked what would prevent her from selling her land to a company like this. Mr. Watkins said there is a penalty of $200 per day for any Zoning Violations.   She also wanted to know if this was a commercial business.  Mr. Watkins answered yes…that’s why we are having to go through all of this.

Mr. Watkins said what we are doing today is requesting this as a permitted use but we are doing a special exception.

Ms. Carter asked about the penalty and said that it may not matter to them. Mr. Watkins said that after repeated offenses, they could go to jail.

Henry Carter – When the County does this, it opens up for anything to come to the county. Mr. Watkins said this is just a tire processing facility. Anyone who wants to do this will have to appear before the Board of Zoning Appeals.

Reggie James – has DHEC done studies? Mr. Watkins said that a company has to meet our Zoning to submit to DHEC.

He asked if the oils from the tires cause birth defects in later years. Mr Watkins said that he did not have the technical expertise and said that DHEC is utilizing the place to determine if it is safe.

Eva Durant – how dangerous is it going to be for the employees of this company. Mr. Watkins said that OSHA or DHEC would determine that.

Mr. Watkins said these are all over the country and have stuff in place for safety.

Robert Brown – if this plant does come, will the tire companies still have to pay a disposable fee for tires? Mr. Watkins said the tire company will still have to pay the fee because the state reimburses us to haul tires.

Pat Carter – in the state of New York, they are worried about the health of children and senior citizens. She said we need to investigate these companies before they get started.  She gave an example of playground and recycled tires over time can cause contaminants.

Mr. Watkins said that DHEC will monitor and they will make sure it is done as safely and as efficient as possible.

Dorothy Mills – Does DHEC have the final decision. Mr. Watkins said yes.

Henry Carter – are there any plants like this in South Carolina?  Mr. Watkins said Sumter has one and Moncks Corner has one.  Mr. Carter asked if anyone had checked on the plants or people in these communities.

Mr. Watkins said the County is only looking at land use. He said that DHEC and OSHA will be concerned with the safety.

Mr. Carter said that someone really needs to investigate in other counties.

Councilman Addison asked if it will be an enclosed facility. Mr. Watkins said yes, the machine will be inside the building.

Councilperson Caughman said the Council needs to make sure extra safeguards are in place. Councilperson Josey said that each individual business should come before the Board of Zoning Appeals.

Mr. Watkins the Board of Zoning Appeals would publicly notice the public hearing.

The public hearing closed at 10:22 a.m. on a motion made by Councilman Beasley, seconded by Vice-Chairman Eckley. Chairman Windham called for the vote, and motion carried.  All voted in favor.

Mr. Watkins said the Council had just had a public hearing on this matter and it had been changed from a permitted use to a special exception in a rural district by the Board of Zoning Appeals after a public hearing.

Councilman Beasley made the motion to approve for second reading approval of ordinance. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

He said this was $11 million investment with 153 jobs. He said that a job fair was held in Bishopville, and there were 400 applicants.

Michael Kozlarek and Jay Schwedler have been working on this project for several months. Mr. Watkins said that their taxes would be reduced from 10.5% to 6%.  He said that there would be public hearing before the third reading to finalize the process.  He said they will hopefully be hiring in the fall.

Chairman Windham thanked Jay Schwedler for his help with this project. Mr. Schwedler said that Crowne Industries had visited eight locations, and it got down to Lee County and one other, and they chose us.  Mr. Schwedler said that he had had several conversations with these folks, and he said they would be good partners to the community.

Vice-Chairman Eckley thanked Jay and his staff for their hard work on this project.

Councilman Beasley made the motion to approve the FILO agreement with Crowne Industries for second reading. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

Councilperson Caughman made the motion to approve for second reading. Councilman Fountain seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

RESOLUTION ENDORSING AND SUPPORTING APPROVAL OF THE RURAL COUNTY TRANSFORMATION FUND BY THE SOUTH CAROLINA GENERAL ASSMEBLY

Mr. Watkins said this Resolution originated in Union County. He said that rural counties are not growing and are being funded on a per capita basis.  He said that Lee County is not getting growth from the tax base, and there is a cap on how much we can go up on taxes.  He said this resolution is asking the state for $20 million to be divided among the 16 smallest counties in the state by the county’s tier status.

He said that Lee County is a tier 4 county. He said that currently the county gets $760,000, and with this proposal, another $950,000 would be added.

Councilperson Caughman said she thought it was a great idea because it was not being put on citizens.

Vice-Chairman Eckley made the motion to approve the Resolution endorsing and supporting the approval of the Rural County Transformation Fund. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

AUTHORIZATION TO UPDATE CONTRACT WITH VICTIMS ADVOCATE

Mr. Watkins said that the County has to update the Contract for Victim’s Advocate every year.

Councilperson Caughman made the motion to approve the contract for Victim’s Advocate. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

APPOINTMENT OF LUKE SMITH TO THE LEE COUNTY ASSESSMENT BOARD OF APPEALS FOR DISTRICT 7

Councilperson Caughman made the motion to appoint Luke Smith to the Lee County Assessment Board of Appeals for District 7. Councilman Beasley seconded the motion. Chairman Windham called for the vote, and motion carried. All voted in favor.

COMMITTEE REPORTS

  1. HEALTH, EDUCATION AND WELFARE

Councilperson Josey recognized Dr. Wanda Andrews and asked her to give an update.

Dr. Andrews introduced some members of her staff and told the Council about some of the new programs going on at the high school.

Councilperson Josey also recognized Thompson Isaac as a member of The Link Board.

Councilperson Josey said she attended the Martin Luther King Breakfast, in which Willie Blyther was recognized as the Community Highlighter.

Councilman Beasley said that Judge Albert Bradley passed away recently and expressed condolences to his family.

  1. PLANNING, TAXES & PERSONNEL

Councilman Beasley said that his committee did not have any meetings. He did mention that we still need to contact the local delegation in reference to the Local Government Fund to ensure that we get what was appropriated before it was cut.

  1. BUILDINGS, L AND & PROPERTY

Vice-Chairman Eckley said that as far as the windows for the courthouse, the contractor said they were backed up and said it would probably be May or June. Mr. Watkins said that if it is really hot weather, we may wait until the fall to do the windows.

Vice-Chairman Eckley said that we had received the storm water permit for the old high school parking lot.

He also said that work on Docs Drive should be done by next school year.

Vice-Chairman Eckley also said that Public Works is developing a list of road for rocking and should be ready in about two weeks.

  1. PUBLIC SAFETY

Councilperson Caughman said the committee did meet on February 2 in regards to litter problems in the county and Sheriff Simon attended and had some ideas. They plan to set up another meeting with “Adopt A Highway” soon. Mr. Watkins said that he brought this up to the Lions Club and they were excited to be a part of this project.

  1. RECREATION AND PUBLIC RELATIONS

Councilman Addison said that he had seen a good bit of damage to the parks.

Thaddeus Dickey said they were trying to get senior citizens involved in recreation. He said they were starting bingo in the gym and a healthy snack would be provided.

He said that basketball ball registration is going on now. He also said that he has gotten a quote for the fencing.

Councilman Addison said that we need to look at the sheds at the parks because some of the shingles are coming off and Mr. Dickey said that he has a contractor looking at it now.

Councilman Addison said that he attended NAACP banquet in which Drink Small was honored for his birthday.

  1. WAYS AND MEANS

Councilman Fountain said that his committee did not meet. He did say that the new budget year would be starting soon.

Mr. Watkins said that he met with Department Heads and Elected Officials on Friday and handed out the budgets. He said that it would be another tough year for the budget.

Councilman Addison recognized Carrie Gass, as being someone who has been faithful and supportive since he has been on Council.

  1. ADMINISTRATOR’S REPORT

Mr. Watkins said that the Council received a good audit report. He said that we received an unmodified opinion, which is the highest opinion that a County can receive.

Councilman Beasley recognized Queenie Boyd as the new President of the School Board Association.

PUBLIC COMMENT

Carrie Gass said she has some concerns because there is no place to pay utility bills now and wanted the County to look into it.

She also wanted the County to look at the sign at Garrett Field because it was in need of repair.

Eva Durant – Thanked Council for their help and support with the Fatherhood Initiative when it was active.

Henry Carter – asked if the County was going to have another public hearing because we amended our amendment to the Zoning Ordinance in regards to the Waste Tire Processing Facility. Mr. Watkins said no….and said that final language will be drawn up before the third and final reading.

Mr. Watkins said that this matter needed to be taken care of today so they could move forward with the purchase of new equipment. He said this was a $14 million investment with 9 new jobs.

Mr. Watkins said that SAC was upgrading the facility and machinery over a five year span. He said the nine new jobs would pay an average of $19 per hour. He said they were entitled to a reduction of fee agreement from 10.5% to 6% in taxes for a 30 year agreement.  They also qualified for 15% SSRC for 15 years.  He said the balance of taxes collected will be divided between county and school district.

He said they were replacing the roof on the building and doing work in the parking lot. He said the upgrade in equipment would be inside the building.

Councilperson Josey made the motion to approve for third and final reading. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

  1. TEXT AMENDMENT TO AMEND THE LEE COUNTY ZONING ORDINANCE TO PERMIT A WASTE TIRE PROCESSING FACILITY AS A SPECIAL EXCEPTION IN A RURAL DISTRICT BY THE BOARD OF ZONING APPEALS AFTER A PUBLIC HEARING

Mr. Watkins said he received a letter from the Planning Commission on December 28, 2016 requesting to amend the Zoning Ordinance to allow a tire processing plant. There was concern being a permitted use instead of a special exception.

The Council amended the proposed request to allow a waste tire processing plant to be allowed as a special exception in which you apply for a permit and then would have to appear before the Board of Zoning Appeals and have a public hearing and meet the five additional guidelines set forth by Council. He said that Council is authorizing the zoning but the person applying would have to obtain a permit from SCDHEC, and there is a list of requirements.

Councilman Beasley made the motion to approve for third and final reading. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

SHEHEEN, HANCOCK & GODWIN WILL PRESENT THE LEE COUNTY AUDIT FY 2016

 Mark Wood, of Sheheen,Hancock and Godwin presented the audit to the Council. He said that the County had received an unmodified opinion, which is the highest opinion that you can receive as a county.  He discussed the highlights of the audit with the Council.

Chairman Windham thanked them for their hard work in putting the audit together. He also thanked Connie Brown and her staff for all of their hard work.

Mr. Watkins also noted that the County has not had do a TAN in about eight years and is better financial shape today than they were 10 years ago.

Councilman Beasley asked Mr. Wood about any findings they found in doing the audit report. Mr. Wood said they did find some things, but nothing out of the ordinary. He noted that most of the findings had to do with staffing problems and things were in place to address those.

Chairman Windham also thanked Wayne Capell and his staff for the great job they do.

Councilman Addison asked Mr. Wood if a special budget account be added for luncheons, etc. for committees. Mr. Wood said that a special account could be set up for that or it could be budgeted under an existing account.

PROCLAMATION HONORING DRINK SMALL FOR HIS 84TH BIRTHDAY

 Chairman Windham said that Bettie Toney had asked him if the Council would consider doing this proclamation and honor Drink Small for his 84th birthday and asked Ms. Toney if she would come and accept this proclamation on his behalf.  Chairman Windham read it and she accepted the proclamation on Mr. Small’s behalf and thanked the Council for recognizing Mr. Small.

Mr. Watkins said that he received a letter from Lee County Planning Commission requesting that a text amendment be done to the Zoning Ordinance to make a waste tire processing facility a permitted conditional use in a rural district. He said that anyone wanting to do this would have to appear before Board of Zoning Appeals.  He said we would have to have two more readings and a public hearing.

Councilman Beasley made the motion to approve for first reading. Councilman Fountain seconded the motion.  Chairman Windham called for the vote, and motion carried. All voted in favor.

AUTHORIZING THE EXECUTION AND DELIVERY OF AN INCENTIVE AND CONVEYANCE OF PROPERTY AGREEMENT AMONG LEE COUNTY, THE CITY OF BISHOPVILLE AND PROJECT TIDE: A FEE IN LIEU OF AD VALOREM TAXES REAL PROPERTY LOCATED IN LEE COUNTY TO PROJECT TIDE: THE PROVISION OF CERTAIN OTHER INCENTIVES FOR PROJECT TIDE; THE INCLUSION OF THE REAL PROPERTY TO BE CONVEYED TO PROJECT TIDE IN A MULTI-COUNTY INDUSTRIAL PARK WITH SUMTER COUNTY; THE EXECUTION OF DELIVERY OF ANY DOCUMENTS NECESSARY TO EFFECT THE INTENT OF THIS ORDINANCE; AND ANY OTHER MATTERS RELATED THEREO.

Mr. Watkins said this related to Project Tide, the industry that planned to locate in Lee County. He said we were doing this in name only today.  He said this industry was a $12 million investment with 150 jobs.

Councilperson Josey made the motion to approve for first reading. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON THIRD READING APPROVAL OF ORDINANCE

  1. TEXT AMENDMENT TO THE LEE COUNTY ZONING ORDINANCE TO APPROVE AND ADD SECTION 2-21-4 “OUTDOOR SHOOTING RANGE: AS A NEW USE AND TO BE PERMITTED IN THE RURAL DISTRICT AS A SPECIAL EXCEPTION

Mr. Watkins said this had been requested from the Planning Commission for a development of a gun range through special exception. Anyone wanting to do this would have to go before the Board of Zoning Appeals.

Councilman Addison asked if it would be open to the public. Mr. Watkins said yes.  Councilman Addison asked if Council would have any discretion of the shooting range.  Mr. Watkins said this is a business, and the Board of Zoning Appeals would address any concerns that people had and would make sure that the shooting range was compliant.  Councilman Addison asked if the general public would have access to the gun range, and Mr. Watkins said yes.

Councilman Beasley made the motion to approve for third and final reading. Councilman Fountain seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

  1. TEXT AMENDMENT TO THE LEE COUNTY ZONING ORDINANCE OF ARTICLE 7, SUPPLEMENTARY DISTRICT REGULATION WITH A NEW SECTION, “SECTION 7-34 OUTDOOR SHOOTING RANGE,” WITH GUIDELINES

Mr. Watkins said this was basically the second location within the Zoning Ordinance with change in wording, known as Exhibit A.

Councilman Beasley made the motion to approve for third and final reading. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

COMMMITTEE REPORTS

  1. HEALTH, EDUCATION AND WELFARE

Councilperson Josey did not have a report.

  1. PLANNING, TAXES & PERSONNEL

Councilman Beasley said that his committee had not met. He did have a concern about the litter in Lee County.  He said that he did not know what Council could do about it, but wants to have this issue referred to the Public Safety Committee.

BUILDINGS, LAND & PROPERTY

Vice-Chairman Eckley not here.

Mr. Watkins said the County was proceeding with the next phase, which included the large arch windows but will not start until March or April.

  1. PUBLIC SAFETY

Councilperson Caughman said they did not have any meetings.

Simon Major said that everything was going good at the prison.

Tim DuBose said they finished the year with 4,975 calls for 2016. He said that finished 2016 as Number one in the state with data collections at DHEC.  He said that DHEC monitors everything in reports and give a data score.

Chairman Windham thanked Tim and his staff for the great job they are doing.

  1. RECREATION AND PUBLIC RELATIONS

Councilman Addison said that his committee did not meet in December; however, he did meet with Quality of Life and Transportation.

He asked that anytime that Thaddeus Dickey cannot be present at the meeting, he would like Mr. Dickey to give him a written report.

Mr. Watkins said he would.

Councilman Addison said that the shingles are torn and some of the siding is coming off on the shelter at Garrett Field.

Mr. Watkins said they County is working on redoing ballfields and parks and playgrounds.

  1. WAYS AND MEANS

Councilman Fountain said that department heads are doing a good job staying within their budgets.

  1. ADMINISTRATOR’S REPORT

Mr. Watkins said he met with FEMA in regards to the reimbursement for Hurricane Matthew. He said the County did have some damage and said we could be reimbursed for 75% of the cost to repair and can also get reimbursed for overtime and equipment used. Mr. Watkins said that hopefully the state will give us the 25% difference.

He also mentioned that the City is hosting a retirement drop in for Mike Deas on Friday from 5-7.

PUBLIC COMMENT

Major Simon said that the Sumter Lee Correctional Institute has job openings.

Bettie Toney asked if Lee County has a homeless shelter. Mr. Watkins said no.  She asked the Council to consider establishing a homeless shelter.  Chairman Windham said this would be referred to a committee.
