OPEN MEETING AND INVOCATION

 Chairman Windham called the meeting to order and welcomed everyone. Councilman Addison gave the invocation.

REQUEST FOR MOTION ON ADOPTION OF RECOMMENDED AGENDA

 Councilman Beasley made the motion to approve the agenda as written. Vice-Chairman Eckley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON ADOPTION OF MINUTES FROM REGULAR MEETING OF NOVEMBER 10, 2015

 Councilperson Josey made the motion to approve the minutes from regular meeting of November 10, 2015 as mailed. Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.

REQUEST FOR MOTION ON FIRST READING APPROVAL OF ORDINANCE

  • APPROVAL OF PROPOSED TEXT AMENDMENT TO THE LEE COUNTY ZONING ORDINANCE TO AMEND THE PENALTY LANGUAGE IN ARTICLE IX, ADMINISTRATION, ENFORCEMENT, AND PENALTY SEC 9-10 TO INCORPORATE THE PENALTY OF THE MISDEMEANOR .

 

Mr. Watkins said the he had received a request from the Planning Commission to change the language, which currently does not include an actual penalty but just states misdemeanor. Mr. Watkins referenced Article IX, which stated that upon conviction the person shall be fined not more than $200 or imprisonment for not more than 30 days of each violation.

Ms. Arlene Samuel reiterated that this amendment was for any violations against the ordinance and each day counts for a violation.

Councilman Beasley made the motion to approve for first reading approval. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

  1. APPROVAL OF PROPOSED MAP AMENDMENT TO THE LEE COUNTY ZONING ORDINANCE ON TMP 030-15-00-002 OWNED BY LONGVIEW FAMILY LIMITED PARTNERSHIP FROM A DEVELOPMENT DISTRICT (DD) TO RURAL DISTRICT (RU)

Mr. Watkins said that had received this request that had been heard by the Planning Commission to change zoning to Rural District on a project.

Ms. Samuel said the Planning Commission had received the required forms necessary to change from Development District (DD) to Rural District (RU). She said the property is off Wisacky Hwy, and the purpose of this change was to locate a solar farm. She said it was 50.57 acres and was changing from DU to RU and said that solar farm is a permitted use.

Mr. Watkins said that solar farms are locating in many other counties and significant money is being generated. He said this would not generate many jobs would generate tax revenue.

He said that if solar is in place, the tax assessment would be based on equipment.

Councilman Addison asked if it was more than one property. Mr. Watkins said it was three different tax map numbers.

Councilman Addison said that since one of our councilmen excused himself, he asked if the Council could have a called meeting to eliminate situations like this of not being aware of information and asked if this was the reason for being excused.

Chairman Windham responded to Councilman Addison that Vice-Chairman Eckley was excusing himself because this request involved him and his family.

Mr. Watkins said that Vice-Chairman Eckley could not have council discussion, and the county attorney said he could answer questions as a private citizen

Chairman Windham said that Vice-Chairman Eckley could not be in decision making process.

Councilman Addison wanted to know if the Council had discussed the safety issues for the community.

Mr. Watkins said that the Planning Commission had heard and recommended to Council which means they are in agreement.

Councilman Beasley made the motion to approve for first reading approval. Councilman Addison seconded the motion.  Chairman Windham called for the vote, and motion carried.

  1. APPROVAL OF PROPOSED MAP AMENDMENT TO THE LEE COUNTY ZONING ORDINANCE ON TMP 037-00-00-025 OWNED BY LONGVIEW FAMILY LIMITED PARTNERSHIP FROM A DEVELOPMENTAL DISTRICT (DD) TO RURAL DISTRICT (RU)

Mr. Watkins said this was the same issue but another parcel of land containing 303.93 acres. He said the use would be a solar farm and said these are adjoining properties that are divided.

Councilman Beasley made the motion to approve for first reading. Councilperson Josey seconded the motion. Chairman Windham called for the vote, and motion carried.  All voted in favor.

  1. APPROVAL OF PROPOSED MAP AMENDMENT TO THE LEE COUNTY ZONING ORDINANCE TO REZONE TMP 030-16-00-001 OWNED BY EDWARD M ALEXANDER FROM A DEVELOPMENT DISTRICT (DD) TO RURAL DISTRICT (RU). ALSO, THE FRONT 400 FEET OF PROPERTY ON THE RIGHT SIDE FROM GENERAL COMMERCIAL (GC) TO RURAL DISTRICT (RU)

Mr. Watkins said this the same project but different parcel. He said this was the same project that would be used for a solar farm, which consisted of 292 acres.

Councilman Beasley made the motion to approve for first reading. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON SECOND READING APPROVAL OF ORDINANCE

  1. LEASE OF COUNTY PROPERTY FOR PRIVATE USE

Mr. Watkins said this property was referred to as the Buffington Building, located in the James Industrial Park, with 4,000 square feet. He said the person leasing it was trying to develop a product to sell to fast food restaurants.  He said there would be no retail sales.  Mr. Watkins this would be a two year lease at $475 per month with a 60 day opt out.  He said the person would be responsible for maintaining the property, insurance and water.

Councilman Beasley made the motion to approve for second reading. Councilperson Caughman seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

COMMITTEE REPORTS

  • HEALTH, EDUCATION & WELFARE

 

Councilperson Josey said she attended a meeting on November 10 with DSS and stockholders of various agencies who serve children and families. She said these agencies were involved with children and families and worked well together with county agencies.

Councilperson Josey said that it was said at the meeting that DSS and various agencies were pleased with the inter-agency cooperation that Lee County had and wished other counties had the same cooperation and effectiveness.

Mr. Watkins said it was a very good meeting, with positive feedback. He said they talked about transportation and how it would impact the county.

Debbie Tindal – she said she did not have report with DSNAP but said many people are still suffering.

  1. PLANNING, TAXES & PERSONNEL

Councilman Beasley said that his committee did not have any meetings but still is talking with Alan in regards to flood issues and FEMA and said that pipes and ditches are still overflowing and are trying to get some much needed help from FEMA. He said he hopes to recoup from money from them.

  1. BUILDINGS, LAND & PROPERTY

Vice-Chairman Eckley said that the county has completed all paint and carpet on the first floor of the courthouse and that was done in house by maintenance supervisor. The outside of the courthouse was also pressure washed.  He said that the grounds will stay as is until the work on the windows is complete.

  1. PUBLIC SAFETY

Councilperson Caughman said that her committee did not meet last month. She commended the EMS and Fire departments for taking care of the people in need in the county.

  1. RECREATION AND PUBLIC RELATIONS

Councilman Addison said Mr. Dickey was not present to give a report. He said he did not have a report at this time.

  1. WAYS AND MEANS

Mr. Fountain was out of town. Mr. Watkins said the county was at the half way point in the budget and everyone was keeping within their spending.  He commended the department heads for the good job they are doing.  Mr. Watkins said that the county did not have to do the TAN this year, and has been the case for the past several years.

  1. ADMINISTRATOR’S REPORT

Mr. Watkins said that the building for the animal shelter has been delivered and on site. He said he hopes the pad will be poured within two weeks and hopes that it will be ready for use by early spring.

He referenced the meeting with DSS state officials and said that it was a good meeting and very informative.

Mr. Watkins said that the County has retained inspections for property of the old Bishopville High School and has put out for bid for the abatement of the asbestos. He said the asbestos should be out of the building by late January.

Mr. Watkins said Brandon Holloman was doing a great job with the coordinating of the FEMA efforts, even though this was a tedious process. He said that the only road that is still close that the County is responsible for is Louie Hancock Road and said that it will be spring before it is opened.

Mr. Watkins said the local disaster center offices are still open at Chappell Park and it will be determined soon whether there is a need to keep this office open.

He said that FEMA has seen over 1800 residents and said that people can still make claims. He said that FEMA will send a representative to your house and the deadline has been extended 30 days.  Mr. Watkins said that January 4 is the last day a claim can be made.

PUBLIC COMMENT

Carrie Gass thanked Council for their support of the Dennis CTC Banquet and said the music and food was good.

She also asked if she could get a copy of the information submitted for the solar farm project.

REQUEST FOR FIRST READING APPROVAL OF ORDINANCE

  1. LEASE OF COUNTY PROPERTY FOR PRIVATE USE

Mr. Watkins said that the Buildings, Land & Property Committee met on a matter in reference to the lease of the Buffington Building.  He said that Ken Marquis was interested in leasing the 4,000 square foot building at $475 per month for a period of two years.   Mr. Watkins said that he would be making a mechanism for fast food restaurants that would enhance their cup dispensers.  He said the County did not have a current use for the building. The committee discussed several stipulations that he would adhere to, such as being responsible for utilities.  Mr. Watkins said the contract would give a 60 day out option for both parties.

Vice-Chairman Eckley made the motion to approve for first reading.  Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR THIRD READING APPROVAL OF ORDINANCE 

  • AGREEMENT WITH SANTEE WATEREE RTA FOR BUS STOPS ON COUNTY PROPERTY

 

Mr. Watkins said that he had received a formal request from Santee Wateree RTA outlining the bus routes.  In finalizing the locations for the bus stops, there were three that are located on county property.  Mr. Watkins said there would be no cost to us, and this would not be lease agreement, but rather an agreement with a 30 day option out for both parties.  The three bus stops on county property were the parking lot between DHEC and DSS, behind the old Bishopville High School where adult ed is located, and behind City/County Complex.

Vice-Chairman Eckley made the motion to approve for third and final reading.  Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried. All voted in favor.

COUNTY WIDE JURY SELECTION FOR MAGISTRATE COURT

 

Mr. Watkins said the County had received a request from Judge Gipson requesting the Magistrate’s Office to offer defendants the choice of county wide jury selection rather than just district wide.  He said this would expedite trials and cut costs and also cut down on citizen’s time of service.

Councilperson Josey made the motion to approve for third and final reading.  Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried. All voted in favor.

COMMITTEE REPORTS

  • HEALTH, EDUCATION AND WELFARE

 

Councilperson Josey said the County is still in the process of getting flood situation taken care of, and they have done a great job.  She said the SNAP benefits program went well in the County.  She said the director of DSS is not here today.  She said their state director is at their offices today, and Council is invited to a workshop from 1-3 this afternoon.

She also commented that 2500 residents went through to get Disaster SNAP benefits.

She also commented that the County had lost one of their former councilmen, Sam McCutchen, and said he will be greatly missed.  She also mentioned that Hannah Mae Hickman had recently passed away, and said she will be missed.

  • PLANNING, TAXES & PERSONNEL

Councilman Beasley said his committee did not meet.  He did say that he had met with Mr. Watkins and went over the flood problems to address plans in the future.

He said that he attended a lunch meeting at Mary McLeod Bethune Park and celebrated the burning of the deed.  He said they were interested in putting lights on the outside of the park.

Councilman Beasley said that he had received complaints on the mosquitoes and said we should see if we can get some help from FEMA, since this was a result of the flood and also commented the county was still receiving calls about problems with dirt roads, as a result of the flood.

  • BUILDINGS, LAND & PROPERTY

Vice-Chairman Eckley introduced Jay Schwedler, Executive Director of Economic Development.  He introduced his staff of Eliza Buxton, Kip Dillihay, Erika Williams.  He said they have been very busy.  Mr. Schwedler said that Lee and Sumter are a two county alliance and have to raise funds to get funds.  He said they have raised $350,000 and received $350,000 in June.

Vice-Chairman Eckley said that he met with Senator Hugh Leatherman in a called meeting regarding the match money going to counties for economic development.  He said that several in the Senate want to do away with that money going to counties, but Senator Leatherman is a supporter of it.  Vice-Chairman Eckley said that Lee/Sumter Counties meet the requirement to get the funding, and we are ahead of everyone else.

Vice-Chairman Eckley said the County has received bids for the asbestos abatement and in contact with DHEC to meet state requirements.  He said the painting is complete in the courthouse and carpet installation will start tomorrow on first floor.  He also said that large overgrown shrubs and dead trees are being removed from the courthouse grounds and will be replaced with smaller shrubs and grass for easier maintenance.

  • PUBLIC SAFETY

Councilperson Caughman said that her committee did not have any meetings.  She said that public safety was working hard on the aftermath of the flood.  She thanked everyone for the great job they are doing.  She also thanked the people at the Animal Shelter for the good job they are doing.

She read the card from Rhonda, her sister, on hehalf of her family, in the passing of Sam McCutchen.  She thanked everyone at the courthouse for their prayers, visits, and phone calls during Mr. Sam’s illness and his passing.

Reverend Eddie Thomas said that Sam McCutchen will be missed and meant so much to his community.

Reverend Thomas said that Good Samaritans had served 868 families just this month due to the flood.  He said that he really needed Council’s help and support.

  • RECREATION AND PUBLIC RELATIONS

Councilman Addison said that Mr. Dickey was not present, and Mr. Watkins said that he was busy with basketball registration and such.  He said that FEMA had set up offices at Chappell Drive and would be open from 8-7 Monday through Saturday.  He said that football season was complete, and they had been busy getting Ashwood gym ready for the reunion.

Councilman Addison said that he was planning a Recreation committee meeting soon, and Quality of Life would meet again after the first of the year.  He said that the transportation bus was new to the community and would take to build ridership.

  • WAYS AND MEANS

Councilman Fountain said that all departments are operating within their budgets.

  • ADMINSTRATOR’S REPORT

Mr. Watkins said that in regards to the flood, the County will be meeting with FEMA on Thursday in regards to overtime pay, for public works employees and public safety officials.  He said that public works employees worked on over 100 dirt roads in nine days, and FEMA should reimburse 75% reimbursement rate.

He said he attended a grand opening of the Central Carolina Technical and Industrial Training Center in Sumter.  He also attended a strategic planning session at Santee Lynches COG on November 2.

Councilman Beasley mentioned the complaints from last meeting on the shelter that was opened at the old high school during the flood.  Mr. Watkins said that he followed up with those complaints and did talk to Red Cross.  They said they did not want to put their people in danger on the road.   That was the reason we did not follow protocol.  The complaint was made that there was no food at the shelter, but there was limited food with basic snacks and water.

PUBLIC COMMENT

Carrie Gass – thanked Mr. Beasley for coming to the Mary McLeod Bethune Park lunch.  She wanted to say thank you to the Council for all that they have done since its inception in 1985.

She also mentioned that on November 27 the Dennis Community Center will be having its 3rd fundraiser for its pre-centennial celebration, and they will be honoring Betty Mae Toney.  She said the tickets will be $20 each.

REQUEST FOR MOTION ON ADOPTION OF MINUTES FROM REGULAR MEETING OF APRIL 14, 2015

 Councilperson Josey said there were two corrections, Issac Felix should replace Herman Felix, and Robert Brown should replace Robert Bradley.

Vice-Chairman Eckley made the motion to approve the minutes with these corrections.  Councilman Beasley seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

REQUEST FOR MOTION ON ADOPTION OF FIRST READING APPROVAL OF ORDINANCE

 LEE COUNTY BUDGET FY 2015-16

Mr. Watkins said that Ways and Means Committee had met with department heads, elected officials and outside agencies, and the total of their requests came to $12,069,286.57.  The

projected revenues were $11,598,411.85, which left a deficit of $470,874.72.  Mr. Watkins said that the county would hopefully be able to do something for employees. He said that if the Local Government Fund were fully funded, it could have resulted in additional approximately $300,000.  However, it will not be fully funded.  Our legislature did vote for full funding, but it did not pass.

Councilman Beasley made the motion to approve for first reading. Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

Chairman Windham thanked the Ways and Means Committee for their hard work in preparing the upcoming budget.  Councilman Beasley said that the worst thing about this year’s budget is the unknown from the state.  Chairman Windham said there some talk in house that they may cut some more.

  • LEE COUNTY SCHOOL BUDGET FY 15-16

Mr. Watkins said the school district is requesting using 2014/15 school figures with 1.62% millage increase.  He said the school’s current millage is 137.9 mills plus the 1.62% would equal 2.2 mill increase, which equates to $50,600 increase.  The total budget for the school, with the increase, would be $3,527,693.

Dr. Wanda Andrews said that school district is still finalizing budget.  She said they will have final figures by June 9 public hearing.

Councilman Fountain made the motion to approve for first reading.  Councilperson Josey seconded the motion.  Chairman Windham called for the vote, and motion carried.  All voted in favor.

Councilman Beasley asked what the value of school millage was.  He said that what you pay on taxes for business and 6% homes help pay the school millage. He said that everything except the 4% taxes go to school.

  • FORMATION OF COUNTY ARCHIVES COMMISSION

Mr. Watkins said that county was going to establish a local archives.  He said that Cecil Stevens has been a proponent, and a local committee has been formed.  He said that the Council would pass an ordinance to set up commission to oversee archives.  He said the County’s role would be to set up committee, and then the committee would take it from there.

Councilman Addison asked if the Chamber would be a part of the archives.  Chairman Windham said that it would be a separate of the Chamber.

REQUEST FOR MOTION ON ADOPTION OF THIRD READING APPROVAL OF ORDINANCE

  • CONTRACT WITH CAPITAL SOLUTIONS TO PROVIDE SMALL BUSINESS SERVICES SUPPORT THROUGH CHAMBER OF COMMERCE

Mr. Watkins said this has been discussed in detail and would only be implemented only if we receive a grant.  He said they would help with business plans, loans through a bank, and website designs.

Councilman Beasley made the motion to approve for third and final reading.  Councilman Fountain seconded the motion.  Chairman Windham called for the vote, and motion carried. All voted in favor.

COMMITTEE REPORTS

HEALTH, EDUCATION & WELFARE

Councilperson Josey attended a book signing for Congressman Clyburn at Lee County Middle School, which was very successful.  She said the school did a great job.

Councilperson Josey recognized Dr. Wanda Andrews and Queenie Boyd.  Dr. Andrews said that all the schools and the district office have websites and a facebook account.

She stated the school district was having Employee Recognition tonight to recognize staff for the great jobs they do.

She said that the school has made a lot of progress, and the students have made progress academically.  Dr. Andrews said she was proud of the teachers and students.  She also said the summer camps would begin as soon as school is out and all types of camps would be offered.

Councilman Addison asked Dr. Andrews to speak about the “Strengthening Families” program.  She said the school had partnered with First Steps and taught the children about child rearing and parenting skills.  She said the program was successful.

Debbie Tindal said that DSS helped 2,756 families for the month of April.  She reminded everyone that DSS is now a call center, so basically, the workers at Lee County DSS helped 2,756 clients.

He reported that he, Mr. Watkins, and Councilperson Caughman attended the Council on Aging banquet.  He said that Yancy McGill was the speaker, and his speech was very positive.

Carrie Gass said that Mr. McGill did a great job and his speech was very positive.

  1. BUILDINGS, LAND & PROPERTY

Vice-Chairman Eckley said the County has gotten the final plans on the Animal Shelter.  He said the next step would be putting out for bids.  He said that the Chappell Park Community Center passed the final inspection.

He also reported that Lee County has had some prospects on the spec building.  He said that Lee County is in the final five of prospects.

  1. PUBLIC SAFETY

Councilperson Caughman said the committee did not have any meetings.

Mr. Dwayne Huggins said that everything seems to be on track for public safety.

Tim DuBose said that he put in for a grant and was awarded the grant in the amount of $79,000 to purchase five CPR devices, which will help out a lot.  He said the devices should be in place by the end of June.

He said that EMS is continuing to do Community Outreach in different communities.

Mr. DuBose said that EMS currently has 1 car seat inspector and is in the process of getting more certififed.

Councilperson Caughman thanked everyone for their participation in the dedication at the Fire Station.

Chairman Windham commented that several people had asked the county to recognize Sam McCutchen for his many years of work in the Spring Hill.

  1. RECREATION AND PUBLIC RELATIONS

Thaddeus Dickey said that they are currently in baseball.  He said there has been some interests in rural areas for camps.  He also said there would be a summer camp at West Lee.

Councilman Addison said he attended a book signing for Congressman Clyburn at Lee Middle School and he thoroughly enjoyed it.

Councilman Addison said that he was not able to attend the Council on Aging banquet but said that he was very encouraged of what Senator McGill said he was going to do for Lee County.  He also said that Senator McGill said that Lee County Council on Aging was one of the best that he had seen.

  1. WAYS AND MEANS

Councilman Fountain said that the committee would meet again before the second reading and commented that they had a meeting after this meeting, which was executive session.

Councilman Addison said that he wanted to clarify something on the Woodrow Park.  He said the Recreation Committee met and we made a ruling on it to close it down without contacting a very important person, which is the councilperson in this district.  He said this was disrespectful

to him.  Councilman Addison said that the Committee would meet again and reconsider what we acted on.  He said that we have to make it safe.

Councilman Beasley commended Tim DuBose for their participation in the Relay for Life.

ADMINISTRATOR’S REPORT

Mr. Watkins said that in reference to the bathroom, the Recreation Committee did meet and recommendation was made to replace the current bathroom.  He said they agreed that a larger facility was needed and the current facility would be moved to Ashwood Lake, which would put two bathroom facilities at Ashwood.

Mr. Watkins said that the County would be constructing a new restroom at MM Levy Park, and this would be worked through the budget.

Councilman Addison asked about specific men and women’s restrooms and said that they needed to be moved more towards the picnic area, along with running water.

Mr. Watkins also commented that these type of restrooms are used nationally and are not inappropriate for this type use.

He also said the County hosted a health screening for employees and recognized Sherry Kerr and Connie Brown for coordinating this event.

Mr. Watkins said that he attended a regional administrator’s meeting in Manning and had some good discussions.

PUBLIC COMMENT

Hannah Hickman – She directed her question to the recreation Department.  She asked how the funding of Chappell Park was provided…by penny sales tax or grant.  She said that a draft of the plaque was presented at the Quality of Life meeting and several people were recognized.

Mr. Watkins said that the Council would respond in writing before the next meeting to the question.

She said that maybe someone could attend the Concerned Citizens Meeting.

Carrie Gass – she asked about the plaque on the building and asked about the position of a grant writer and consultant.  She asked if this position was to the council or county.

She also asked about the formation of the archive committee.  She said she wanted to know the names of the person on committee.  She said she wants to volunteer on committee.

She also asked about the funding of the Mary McLeod Bethune Park and said they did not receive a budget request.  Mr. Watkins said that if the funding stayed the same amount as last year, they would not have received a request form.

Ms. Gass said that she was one of the main people concerned about the restrooms and thanked Council for their reconsideration.

James Felix – thanked County Council for their support of the Magnolia Festival. He said it was successful and everyone had a great time.

Frank Millican – He said that he was glad Council came to their senses and are closing the park in Woodrow.  He said he didn’t mean for the outhouses to be moved to Ashwood.

Robert Brown – he expressed concern about the council meetings be held at 9:30 in the mornings and said that more of the citizens would come to meetings if they were held at night.   Chairman Windham said the next meeting, which would be the public hearing, would be at 6:00 p.m.

Bobbi Adams – she commented on the Archives committee and said that the collection policy on various items for the archives was very important.

 REQUEST FOR MOTION FOR FIRST READING APPROVAL OF ORDINANCE

 AUTHORIZING THE REVISION OF THE CONVENANTS OF A PIECE OF PROPERTY IN THE I-20 INDUSTRIAL PARK

Mr. Watkins said that this was required for updating the deed language in regards to the fee agreement the county had with Ahlstrom.

Mr. Watkins said that Ahlstrom is selling land and equipment to Browntown LLC. Vice-Chairman Eckley read the ordinance info in regards to the sale of the transaction.

Mr. Watkins said the county needed to take this action to make the slae of the land possible.  He said this ordinance references .43 acres of the total tract currently owned by Ahlstrom. He said this would remove the restriction for that part of the covenants. This piece of land had been left out of the original piece of property.

Chairman Eckley made the motion to approve for first reading. Councilman Beasley seconded the motion. Chairman Windham called for the vote, and motion carried. All voted in favor.

RESOLUTION AUTHORIZING THE TRANSFER OF PROPERTY FROM THE LEE COUNTY SCHOOL DISTRICT TO THE COUNTY

Mr. Watkins said the discussion in Executive Session was in reference to the old Bishopville High School. He said the County has long-term lease with the sports facilties and other office facilities. He said the County intends to deal with old building, and the only way to do that is to take possession of the property.

Mr. Watkins said that the county will ensure it will be used for recreation, and if not, the property will revert back to school district. The amount of acreage is 18, which is the old high school, gym, recreation offices, and adult education offices are included. The school will retain the right to use the adult ed building.

Mr. Watkins said that he hopes this will make property safer and accessible to recreation.

Chairman Windham thanked Dr. Andrews and Sonya Moses for their cooperation in this process.

Councilman Addison said that he was glad to see this happening.

He said the county has been working on this for some time and this would be a plus for the county.

REQUEST FOR MOTION ON THIRD READING APPROVAL OF ORDINANCE

  1. AGREEMENT BETWEEN LEE COUNTY AND STRATEGIC CAPITAL SOLUTIONS, LLC TO PROVIDE GRANT WRITING SERVICES

Mr. Watkins said the county had a contract with them for about a year, and the county was just renewing it. He said that it was a contingency based contract and the county would know up front what the grant is and the amount we would be responsible for. He said there would be a 10% fee on each grant that is awarded to County through the work of Capital Solutions.

Councilman Beasley made the motion to approve for third and final reading. Vice-Chairman Eckley seconded the motion. Chairman Windham called for the vote, and motion carried. All voted in favor.

  1. APPROVAL OF ADMINISTRATOR’S CONTRACT

Mr. Watkins this contract was reviewed by the Planning, Taxes & Personnel Committee. He said the main reason this was being revised was due to a Supreme Court decision limiting the term of the contract.

Councilperson Josey made the motion to approve for third and final reading. Councilman Beasley seconded the motion. Chairman Windham called for the vote, and motion carried. All voted in favor.

COMMITTEE REPORTS

  1. HEALTH, EDUCATION & WELFARE

Councilperson Josey said that she attended the 26th Annual MLK breakfast and meetings. She recognized Carrie Gass for being selected for the 2015 Community Spotlight during the annual Martin Luther King breakfast.

Councilman Beasley said his committee did not meet and he did not anything new to report.

  1. BUILDINGS, LAND & PROPERTY

Vice-Chairman Eckley said that the LINK Board met last week . He said they have had several inquiries about the spec building. He also said that Ahlstrom is selling building to a prospect.

Councilperson Caughman said that her committee had not had any meetings. She said there were no department heads to give a report. Mr. Watkins said that Mike and staff were involved in a nuclear power drill and Tim and Steven were at an OSHA meeting.

Mr. Watkins did say that Fire responded to 95 calls and EMS responded to 371 calls. He also mentioned that EMS was sponsoring a Golf Tournament for Relay for Life on March 21.

Councilperson Caughman said she attended a Health Fair at Spring Hill Fire Station and was very impressed with our EMS personnel.

Mr. Watkins said the County plans to locate a plaque at the Spring Hill Fire Station in the near future to recognize the efforts of recently retired Councilman Sam McCutchen.

Mr. Watkins said he attended an Administrator’s meeting in January held in Charleston. He said that he is a charter member of The Lions Club. He said the current number of members is 35. He said The Lions Club provides community outreach and vision needs in the community.

PUBLIC COMMENT

Bobbi Adams wanted to compliment Council on the new Animal Control officer. She said that Animal Control had picked up a great dane dog that was too big to handle. She also commented that, per Todd Branham, we now have rabies in the cat population in town.

Councilman Addison asked what makes a dog too large. Bobbi Adams said that she did not know the size of the traps the City has.

 Mr. Watkins said there was a petition that had been presented to Council and this matter had been referred to the Buildings, Land & Property Committee. The committee recommended to Council to place a plaque rather than rename the building. Vice-Chairman Eckley read the resolution with the inscription of the wording for the plaque.

Mr. Watkins said that Sheriff’s Office provides victims advocate services to Lynchburg. He said that Lynchburg has been collecting fees and fines and will forward the money collected to Sheriff and they will provide the services.

Mr. Watkins responded that the County would know up front what type of grant and the match associated with it.

Councilman Beasley said that it would be good and the County needed to look at every grant opportunity.

 Councilman Addison said that a change needed to be made in the minutes in reference to the restroom for tennis courts on Roland Street. Councilman Addison wanted it in the record that he was concerned about the diameter of the hole of the toilet at Garrett Field and the potential of danger for a small child. He also said he concerned that there was no running water and was concerned about the sanitation of the bathroom.

Councilman Addison also wanted the minutes to reflect that he was present at the ribbon cutting at Garrett Field , along with Senator McElveen and Senator Malloy.

Councilman Beasley made the motion to approve the minute with the revisions. Councilman Addison seconded the motion. Chairman Windham called for the vote, and motion carried. All voted in favor.

ELECTION OF CHAIRMAN AND VICE-CHAIRMAN FOR 2015/16

Chairman Windham said that this term was for a two year period.

Councilman Fountain nominated Travis Windham to serve as Chairman. Vice-Chairman Eckley seconded the nomination. Councilman Beasley made the motion that the nominations come to a close. All of the Council voted in favor for Travis Windham to serve as Chairman for 2015/16.

Chairman Windham said that he wanted to open the floor for nominations for Vice-Chairman. Councilman Beasley nominated Gordon Eckley to serve as Vice-Chair. Councilman Addison seconded the nomination. All of the Council voted in favor for Gordon Eckley to serve as Vice-Chairman for 2015/16.

Chairman Windham thanked the Council for showing confidence in him for the next two years.

Vice-Chairman Eckley said it had been a pleasure working with Chairman Windham and he looked forward to the next two years.

  1. APPROVAL OF ADMINISTRATOR’S CONTRACT

Mr. Watkins said the reason for revision is that a recent Supreme Court ruling limits the time frame of contract offered to administrators. He said that the time of the contract would be changed to two years. Mr. Watkins said the base pay is the same, and the main reason for change is to modify the language to incorporate the two year term.

Councilman Beasley made the motion to approve for first reading. Vice-Chairman Eckley seconded the motion. Chairman Windham called for the vote, and motion carried. All voted in favor.

  1. CONSIDERATION OF JAIL CONTRACT WITH CITY OF BISHOPVILLE

Mr. Watkins said that the contract has not been submitted to the City of Bishopville yet. He said that it establishes a percentage of use as the basis for Bishopville’s jail costs. This is the same formula used to determine the county’s jail costs. The way it is calculated is equivalent to the way our cost it is calculated.

He said the City is up to date, and they are paying based on this formula.   He said that County is responsible for general session and family court jail costs.

Mr. Watkins said that both sides can terminate agreement.

Councilman Beasley made the motion to approve for first reading. Councilperson Josey seconded the motion. Chairman Windham called for the vote, and motion carried. All voted in favor.

REQUEST FOR MOTION ON THIRD READING APPROVAL OF ORDINANCE

  1. AMEND THE FY 2015 BUDGET ORDINANCE TO REMOVE SECTIONS 4 AND 12 FROM THE POLICIES AND PROCEDURES MANUAL

Mr. Watkins said this amendment needed to take place before the new Employee Handbook could be issued. He said the guidelines have been part of the budget ordinance. He said that he had met with a labor attorney and she felt this would be more accessible to employees. Mr. Watkins said that it spells out benefits and employee procedures, so it will be a good thing for employees to have.

Councilman Addison referenced the “at-will” section of the manual and said that he had received all kinds of mixed views regarding this matter. He referred to the section that read that any employee can be fired for any reason. He said that Montana was the only state that has not adopted this policy. He asked if the County adopted that procedure.

Mr. Watkins referred to the state code, which is what this section is based on. He said that employees can still sue for discrimination and they have the right to a lawsuit. He also said that there is a section which deals with grievances for employees.

Chairman Windham said that any finding would be clarified to an employee before the fact. He said this policy was not adding to the Administrator’s authority. He said that all employees would be given the same access.

RESOLUTION TO ADOPT EMPLOYEE HANDBOOK

Mr. Watkins said that each employee will be given a digital copy of the handbook. Councilman Beasley said his committee met and made the recommendation to Council to adopt the handbook.

Councilman Beasley made the motion to approve the resolution to adopt the Employee Handbook. Vice-Chairman Eckley seconded the motion. Chairman Windham called for the vote, and motion carried. All voted in favor.

UPDATE COUNCIL ON POTENTIAL SMALL BUSINESS SERVICES GRANT OPPORTUNITY

Mr. Watkins said that Strategic Capital Solutions has proposed to the County to help us write some grants that may provide some growth opportunities. He said they have worked in Allendale and Williamsburg counties. Mr. Watkins said they will work through the Chamber to provide services for small businesses for people trying to start new businesses. Mr. Watkins said this would be a good investment for the county.

Councilman Addison asked if the county could help clean up houses in the county, as in demolition. Mr. Watkins answered that counties don’t have the same authority as municipalities have, but he said the SCAC is addressing this.

Councilman Addison referenced that Santee Lynches cleans up property and then obtains property, and after three years, it goes back to the City.

COMMITTEE REPORTS

  1. HEALTH, EDUCATION & WELFARE

Councilperson Josey said she hopes everyone will attend the Martin Luther King celebration services on Sunday, January 18 and the breakfast on Monday, January 19 at the Lee Central High School.

  1. PLANNING, TAXES & PERSONNEL

Councilman Beasley said his committee met to discuss the jail contract and the administrator’s contract.

  1. BUILDINGS, LAND & PROPERTY

Vice-Chairman Eckley said that work was still in progress at the Bryant building. He also said that progress is being made on the Community Center on Chappell Road. Vice-Chairman Eckley said the County is working with the architect on repairing/replacing windows in the courthouse.

  1. PUBLIC SAFETY

Councilperson Johnette Caughman said that was honored to be on Council and thanked EMS, Fire and Sheriff’s Office for keeping everyone safe.

Tim DuBose said that EMS had responded to 4,366 calls in 2014 and the call volume was up so far this year. He said EMS raised $1300 for the Turkey Shoot for Relay for Life. He said that EMS would be sponsoring a golf tournament on March 28 as a fundraiser for Relay for Life.

Mr. DuBose said that EMS would be hosting a health fair in Spring Hill on Saturday morning, just like the one that was done in Lynchburg. He said he hopes to do a health fair in the Turkey Creek area some time in April.

Councilman Beasley commended Tim and his department for the revenue collected for 2014.   Mr. DuBose also said that flu season is in peak season now.

Councilperson Johnette Caughman said she was thankful for Station 10 in the Spring Hill community.

Sheriff Danny Simon thanked the Council for the cars that were purchased with the bond money. He also said that break-ins have increased. Sheriff Simon said that he had nominated three officers, namely, Leroy Durant, Shante Demary, Calvin Collins, for the Medal of Valor Award, through the SC Sheriff’s Association. He said the ceremony would be on Thursday night at 6:30 in Columbia.

  1. RECREATION AND PUBLIC RELATIONS

Councilman Addison said that Thaddeus Dickey was not present to give a report. He said that Bettye Scott would be at next month’s meeting to give a report on transportation.

Mr. Watkins said the Chapell Community Center had been roughed in for electricity and plumbing and should be wrapped up in 45-60 days.

Mr. Watkins said materials had been ordered and installed in the bathrooms at Garrett to make their more safe.

  1. WAYS & MEANS

Councilman Fountain said the new budget year will start in a couple of months. He also introduced Charlie Allen, as the new Executive Director, of Black River Electric Coop.

Nothing at this time.

Chairman Windham went over a few goals and objectives that he would like the Council to accomplish within the next year.

  1. Build on Link and county’s plan for economic development
  2. Transfer of Bishopville High property and improve safety
  3. Development of Lee County Archives
  4. Complete bond referendum projects
  5. Construction of Chappell Community Center
  6. Construction of Animal Shelter
  7. Installation of Splash Pads
  8. Window repair and replacement
  9. Painting and remodel of courthouse

PUBLIC COMMENT

William Hemby, a resident who lives near Councilperson Johnette Caughman, said that he appreciates the Spring Hill Fire Department. He said that, in honor of his services, he was requesting that the County rename the fire department to the J. Samuel McCutchen Fire Station. He said that he had a petition of about 100 names to present to council.

Chairman Windham thanked him for coming and referred this to Vice-Chairman’s committee of Buildings, Land & Property.

Hannah Hickman told Mr. Watkins he did a good job explaining the “at will employment” on the handbook, but asked to see the state code that explains ‘At will”.
